AN ACT to repeal and re-enact, with amendments, Sections 401 to
408, inclusive, of Article 66C of the Annotated Code of Maryland
(1957 Edition and 1960 Supplement), title "Natural Resources",
sub-title "Forests and Parks", sub-heading "Tree Experts"; and
to add a new Section 400 A to the said Article of the Code, to follow
immediately after Section 400 thereof and to be under the sub-
heading "Tree Experts", requiring a license of all persons engaged
in the work or business of a tree expert; revising the definition of
"tree expert"; eliminating the words "silviculturist" and "certi-
fied", wherever they appear; and correcting, clarifying, and revis-
ing the licensing requirements and the penalty, reciprocity and
other provisions of the law.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 401 to 408, inclusive, of Article 66C of the Annotated
Code of Maryland (1957 Edition and 1960 Supplement), title "Nat-
ural Resources", sub-title "Forests and Parks", sub-heading "Tree
Experts", be and they are hereby repealed and re-enacted, with
amendments, and that new Section 400A be and is hereby added to
the said Article of the Code, to follow immediately after Section 400
thereof and to be under the sub-heading "Tree Experts", all to read
as follows:
400A. No person shall engage in the work or business of a tree
expert without a license issued under the provisions of this sub-
heading.

As used in this sub-heading:
"Tree expert" means a person who holds himself out as being skilled
in the science of tree care and who, whether in his own business or as
the employee of another person, partnership, corporation, organiza-
tion or business and whether under the title of arborist [silvicul-
turist] tree specialist, tree surgeon, tree expert or otherwise
[devotes the regular business hours of the day to] engages in the
business or work of the treatment and care of trees, that is to say,
making diagnoses, and prescribing and supervising treatment for
trees, for compensation.
"Licensed [certified] tree experts"-EXPERT" means a person who
has received from the Commission of Forests and Parks a license
displaying his or her qualifications to practice as a tree expert.
AN EMPLOYEE UNDER THE SUPERVISION OF A LICENSED
TREE EXPERT SHALL NOT BE REQUIRED TO HAVE A
LICENSE IN HIS OWN NAME.
