diately after Section 98 (f) thereof; and that a new Section 108(15)-
(a-1) be and it is hereby added to said Article and sub-title, to follow
immediately after Section 108(15) (a) thereof, and all to read as
follows:
98.
(a) As of June 15, 1955, the County Council for Montgomery
County shall appoint three judges of the People's Court of Mont-
gomery County who shall meet the qualifications provided in this
Article and who shall serve until the first day of May in the year
1963 or until their successors are appointed and qualified. As of the
first day of May, 1963, and as of the first day of May in every eighth
year thereafter, the County Council of Montgomery County shall ap-
point three judges of the People's Court of Montgomery County to
fill the positions then expiring. As of January 1, 1962, the County
Council for Montgomery County shall appoint an additional full-time
judge of the People's Court of Montgomery County who shall meet
the qualifications provided in this Article and who shall serve until
the first day of January, 1970, or until his successor is appointed
and qualified. As of the first day of January, 1970, and as of the
first day of January in every eighth year thereafter, the County
Council of Montgomery County shall appoint one judge of the Peo-
ple's Court of Montgomery County to fill the position then expiring.
One of such judges shall be designated as the People's Court judge
for juvenile causes; one of the judges of the People's Court handling
criminal, civil, and traffic cases shall be designated as chief judge
and administrative officer for the said court, the committing magis-
trates and other personnel.
(e) The [three] full-time judges of the People's Court of Mont-
gomery County shall not engage in the private practice of law dur-
ing their terms of office, and the substitute judge shall not practice
before the People's Court during his term of office.
(f) The [three] full-time judges and the substitute judge of the
People's Court of Montgomery County may be removed from office
by a two-thirds majority vote of the full membership of the County
Council of Montgomery County after a finding by the Circuit Court
of Montgomery County, of incompetency, or of physical or mental
infirmity, or of willful neglect of duty, or of misbehavior in office,
or of conviction, while in office, of any crime involving moral turpi-
tude. Charges under this subsection shall be preferred by the State's
Attorney for Montgomery County, and the accused shall be notified
of the charges against him and shall have the opportunity of making
his defense.
(g) Upon the occurrence of any vacancy or vacancies on said
Court, by the expiration of the term of said judges or otherwise, the
County Council shall request that the Montgomery County Bar As-
sociation OF MONTGOMERY COUNTY, INCORPORATED furnish
it with recommendations of qualified persons to fill such vacancy or
vacancies and shall allow said Bar Association thirty (SO) days in
which to submit said recommendations before making any appoint-
ment; the County Council shall not be bound by said recommenda-
tions IF RECEIVED, but shall make no appointment under this
Section until such recommendations IF RECEIVED shall have been
given due consideration.
