1238 Laws of Maryland [Ch. 735
(A) OF Section 37 of Article 2B of the Annotated Code of Maryland,
1957, title "Alcoholic Beverages", sub-title "Local Licenses and
License Provisions", BE AND IT IS HEREBY REPEALED AND
RE-ENACTED, WITH AMENDMENTS, to read as follows:
(c) Sixth Election District (Darnestown) Local Option. (1)
the Board of Election Supervisors of Montgomery County are directed
to hold a special election within ninety (90) days of the effective date
of this Act to submit to the legal and qualified voters of the Sixth
Election District (Darnestown) of Montgomery County the question
of whether or not the issuance of such class or classes of alcoholic
beverage licenses as are authorised in Montgomery County by this
article, and the sale of such alcoholic beverages by those so licensed,
shall be permitted or prohibited in said Sixth Election District.
(2) The Board of Election of Supervisors are directed to give the
usual public notices of said special election and to generally conduct
said election under the laws governing the conduct of general elections
in Montgomery County, except that said Board shall only be required
to give public advertisement as to the location of the polling place or
places for two (2) weeks preceding the date of the election. The
County Council of Montgomery County is authorized and directed
to pay the expenses of such election.
(3) Any resident of the Sixth Election District of Montgomery
who shall be registered to vote in the general elections in Montgomery
County at least thirty (3) days prior to the date of said special
election shall be permitted to vote in said special election.
(4) If a majority of the votes cast on such question favor per-
mitting the issuance of the aforesaid class or classes of alcoholic
beverage licenses and the sale of such alcoholic beverages by those so
licensed in said Sixth Election District, the issuance of said licenses
and said sales shall be thereafter permitted in the Sixth Election,
District of Montgomery County.
(5) If a majority of the votes cast on such question favor pro-
hibiting the issuance of the aforesaid class or classes of alcoholic
beverage licenses the and the sale of such alcoholic beverages by those so
licensed in said Sixth Election District, the issuance of the licenses
Montgomery County.
(A) WHERE SALE PROHIBITED.—IN MONTGOMERY
COUNTY, NO LICENSE FOR THE SALE OF ALCOHOLIC
BEVERAGES AUTHORIZED BY THIS ARTICLE SHALL BE
ISSUED FOR ANY PLACE OF BUSINESS LOCATED IN ANY
ONE OF THE FOLLOWING ELECTION DISTRICTS OR TOWNS
OF SAID COUNTY: LAYTONSVILLE (1ST DISTRICT), CLARKS-
BURG (2ND DISTRICT), COLESVILLE (5TH DISTRICT),
[DARNESTOWN (6TH DISTRICT),] BARNESVILLE (11TH
DISTRICT), AND DAMASCUS (12TH DISTRICT), AND THE
TOWNS OF KENSINGTON AND TAKOMA PARK.
SEC. 2. AND BE IT FURTHER ENACTED, THAT BEFORE
THIS ACT SHALL BECOME EFFECTIVE, IT SHALL FIRST BE
SUBMITTED TO THE LEGALLY QUALIFIED VOTERS OF THE
SIXTH ELECTION DISTRICT OF MONTGOMERY COUNTY AT
THE GENERAL ELECTION TO BE HELD IN NOVEMBER, 1962.
