J. MILLARD TAWES, GOVERNOR                          1239

THERE SHALL BE PRINTED ON THE BALLOTS OR BAL-
LOT LABELS, TO BE USED IN THE ELECTION, THE TITLE
OF THIS ACT AND UNDERNEATH THE TITLE, ON SEPAR-
ATE LINES, A SQUARE OR BOX TO THE RIGHT OF AND OP-
POSITE THE WORDS "FOR THE SALE", AND A CORRE-
SPONDING SQUARE OR BOX TO THE RIGHT OF AND OP-
POSITE THE WORDS "AGAINST THE SALE", SO THAT THE
VOTERS OF SIXTH ELECTION DISTRICT OF THE COUNTY
ARE ABLE TO DESIGNATE HIS OR HER DECISION FOR OR
AGAINST THIS ACT. IF A MAJORITY OF THE VOTES CAST
IN THE ELECTION IN THE SIXTH ELECTION DISTRICT OF
THE COUNTY ARE "FOR THE SALE", THEN THIS ACT IS
EFFECTIVE, BUT IF A MAJORITY OF THE VOTES CAST IN
THE SIXTH ELECTION DISTRICT OF THE COUNTY ARE
"AGAINST THE SALE", THEN THIS ACT IS NULL AND VOID.

Sec. 2. SEC. 3. And be it further enacted, That this Act shall take
effect June 1, 1961.

Approved May 3, 1961.

CHAPTER 736
(House Bill 915)

AN ACT to add new Sections 333A and 333B to Article 81 of the
Annotated Code of Maryland (1960 Supplement), title "Revenue
and Taxes", sub-title "Retail Sales Tax Act", to follow immediately
after Section 333 thereof, relating generally to a period of grace
under which a vendor may obtain resale certificates under certain
conditions, and matters incident thereto; AND PROVIDING
ALSO THAT THE PROVISIONS OF THIS ACT SHALL AP-
PLY TO SALES PRIOR TO THE EFFECTIVE DATE OF THIS
ACT IN CERTAIN INSTANCES.

Whereas, the State Comptroller has called to the attention of the
General Assembly of Maryland that the provisions of Section 333 of
Article 81 may have a harsh result in the case of certain taxpayers
who have failed to procure proper resale certificates, and that this
may be corrected by providing for a period of grace during which
resale certificates may be procured; now, therefore

SECTION 1. Be it enacted by the General Assembly of Maryland,
That new Sections 333A and 333B be and they hereby are added to
Article 81 of the Annotated Code of Maryland (1960 Supplement),
title "Revenue and Taxes", sub-title "Retail Sales Tax Act", to follow
immediately after Section 333 thereof, to read as follows:

333A. No vendor shall accept a resale certificate for property which
he knows or should know is not for resale.
