censed oystermen, who earn their livelihood by catching oysters. In
the planting of shells or seed oysters in any area, the Department of
Tidewater Fisheries or its successors shall confer with and procure
the advice of the committee of oystermen for the county adjacent
or nearest to the tonging area to be planted. A similar advisory com-
mittee of five licensed dredgers shall be selected to confer and advise
in the propagation of oysters in the dredging areas. In the event
that the lisensed
LICENSED oystermen of any county have not, with-
in thirty (30) days after December 1, 1961, filled the initial appoint-
ments to the advisory committees provided for hereunder, such
initial appointments shall be made by the Department. Where an
initial appointment has been made, but a vacancy has occurred be-
cause of the member's inability or unwillingness to serve, and such
vacancy is not filled by the licensed oystermen of the particular county
within thirty (30) days after the vacancy has occurred, the Depart-
ment shall make the necessary appointments to fill each vacancy.

Sec. 2. And be it further enacted, That this Act shall take effect
on June 1, 1961.

CHAPTER 681

(House Bill 223)

AN ACT to repeal and re-enact, with amendments, Section 5 (a)
of Article 38 of the Annotated Code of Maryland (1960 Supple-
ment), title "Fines and Forfeitures"; and to repeal Section 104 (g)
of Article 52 of the said Code (1957 Edition), title "Justices of the
Peace", sub-title "Trial Magistrates System"; and to add new
Section 48B to Article 20 of the Code of Public Local Laws of
Maryland (1930 Edition), title "Somerset County", sub-title
"County Commissioners", to follow immediately after Section 48A
thereof, as Section 48A was last amended by Chapter 527 of 1959;
relating to the disposition of fines, penalties and forfeitures col-
lected in the circuit court for Somerset County and collected by
justices of the peace of Somerset County, and authorizing the
County Commissioners of Somerset County to appropriate funds
monthly for the support of the Bar Library of Somerset County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 5 (a) of Article 38 of the Annotated Code of Maryland
(1960 Supplement), title "Fines and Forfeitures", be and it is hereby
repealed and re-enacted, with amendments, to read as follows:

5 (a). General.—One half of the fines imposed and recognizances
forfeited to the circuit court for the several counties of the State,
shall be paid to the clerks of the respective courts, to be expended
under the direction of the judge or judges of said courts, for the
augmentation of the libraries of said courts, and one-half of the
fines and recognizances received by the city treasurer of Baltimore
City from the justices of the peace in Baltimore City and the Sheriff
of Baltimore City, as adjudged by and accruing in the criminal courts
