C H A P.
LXXXII.

vivors of them, fhall be paid out of the property before diftribution is made ;
and that the faid truftees, or the furvivor or furvivors of them, fhall, of the re-
queft of the creditors, or any two or more of them annually give them, an ac-
count of their proceedings under this act.

VI. And be it enacted, That the faid Stephen Zacharie fhall and he is hereby
required to aid and affift the faid truftees, or the furvivors or furvivor of them,
in the difcharge of the duties of this act.

Creditors may
inftitute fuits,
&c.

VII. And be it enacted, That it fhall and may be lawful for any of the cre-
ditors of the faid Stephen Zacharie, or of Zacharie, Coopman and company, to
inftitute fuits againft him or them, and profecute the fame to faid judgment, in the
fame manner as before the paffage of this act, any thing herein to the contrary not-

withstanding, but that the court from whence the procefs may iffue fhall and they
are hereby directed, on motion, to difcharge the faid Stephen Zacharie on com-
mon bail; and if the faid Stephen Zacharie fhall be arrefted or impriofoned on any
procefs for any debt, damages or cofts, conftructed, owing, or growing due before
the paffage of this act, the court before whom fuch procefs may be returned fhall
difcharge the faid Stephen Zacharie out of cuftody; provided that the difcharge
of the faid Stephen Zacharie fhall not acquit any other perfon from fuch debt,
damages or cofts, or any part thereof, but fuch perfon fhall be liable for the
fame in the fame manner as if this act had not paffed; and provided alfo that
the faid Stephen Zacharie fhall not obtain or have the benefit of this act, unlefs
he fhall comply with the provifions contained in the first fection of this act, and

unlefs he fhall, on or before the first day of February next, enter from bond to
the faid truftees, in fuch fum of money, and with fuch fecurities, as fhall be
approved of by the prefidents of the refpective banks in the city of Baltimore for
the time being, or a majority of them, not to depart from this ftate without the
confent or approbation of the faid truftees, or a majority of them, in writing
for the fpace of three years from the paffage of this act, which bond fhall be

lodged in the general court office, and be liable to be fued by the faid truftees, or
the furvivors or furvivor of them, for the ufe of the creditors aforefaid.

VIII. And be it enacted, That from and after expiration of the faid three
years, all the privileges, benefits, advantages, releafments, and difcharges ex-
tended or given to the faid Stephen Zacharie, fhall caufe, and he fhall again be
anfwerable to his own creditors, and to the creditors of Zacharie, Coopman and
company, in the fame manner, and liable to the fame procefs, as if this act had

not paffed, except that any property he, the faid Stephen Zacharie, may acquire

from the paffage of this act until the expiration of faid three years, fhall not be
liable to the creditors, except the property excepted in the fecond fection of this
act, any thing; herein contained to the contrary notwithstanding.

Bail to be dif-

charges, &c.

IX. And be it enacted, That in all cafes where the faid Zacharie has
given bail to any fuit or action, fuch bail fhall be made by the faid Stephen
Zacharie's entering into bond as aforefaid, be difcharged, in the fame manner as
if the faid Stephen Zacharie had been furrendered in difcharge of his bail.

X. And be it enacted, That from and after the paffage of this act, any re-
leafement or difcharge that fhall be made by the faid Stephen Zacharie to his
own debtors, or to the debtors of the faid company, fhall be and are hereby de-
clared void.

An ACT to appoint an agent for the year one thoufand feven

hundred and ninety-eight.

Be it enacted, by the General Affembly of Maryland, That William Mar-

bury be agent of this ftate, to execute the truft and power repofed in him
by virtue of this act, from the first day of January, one thoufand feven

hundred and ninety-eight, until the first day of January, one thoufand feven

hundred and ninety-nine.
