C H A P.
LXIX.

eaftern and weftern fhore refpectively, and the clerk of the general court fhall
immediately thereupon iffue a common capias ad refpondendum againft fuch col-
lector and fecurities, or against fuch clerk, returnable to the next fucceeding
court, and judgment on trial fhall be had at the firft term, without any impar-
lance or delay; and thereupon execution fhall iffue againft fuch collector and his
fecurities, and againft fuch clerk, for fuch fuch as by the judgment of the court
fhall appear to be due.

VI. And be it enacted, That every part of an act of affembly paffed at No-
vember feffion, feventeen hundred and ninety-fix, entitled. An act for the better
adminiftration of juftice in the feveral counties of this ftate, which may be con-
trary to, or inconfiftent with, the provifions of this act, fhall be and the fame

is hereby repealed.

Duration.

VII. This act to continue in force until the twentieth day of October in the
year eighteen hundred, and until the end of the next feffion of affembly which

may happen thereafter.

C H A P. LXX.
An ACT to incorporate a company for making feveral turnpike
roads through Baltimore and Frederick counties, until they in-
terfed the divisional line between Maryland and Pennfylva-
nia.

Preamble.

WHEREAS the great quantity of heavy articles of the growth and
produce of the country, and of foreign goods, which are daily tranf-
ported between the city of Baltimore and the weftern counties of the
dates of Maryland and Pennfylvania, requires an amendment of the highways,
which can only be effected by artificial beds of ftone and gravel, difpofed in fuch
manner as to prevent the wheels of carriages from cutting into the foil, the ex-
pences whereof will be great; and it is reafonable that thofe who will enjoy the
benefits of fuch highways fhould pay a compenfation therefor, and there is rea-
fon to believe fuch highways will be undertaken by an affociation of citizens, if
proper encouragement be given by the legiflature; therefore,

II. Be it enacted by the General Affembly of Maryland, That a fubfcription

be opened for a capital of three hundred thoufand dollars, in fhares of one hun-
dred dollars each, and that Samuel Smith, Jofeph Thornburgh, Jeffe Hollingf-
worth and Philip Grable, be and they are hereby appointed managers for taking
fubfcriptions for fixteen hundred fhares at the city of Baltimore, and that John
T. Worthington, George Fifher, Charles Cockey and Philip Shull, be and they
are hereby appointed for taking fubfcriptions for fixty fhares at Rifter's-town ;
and that Jofhua Gift, Jacob Sherman and Henry Stevenfon, be and they are
hereby appointed for taking one hundred fhares at Weftminfter; and that John
Gwinn, Michael Null and Jofeph M'Caleb, be and they are hereby appointed
for taking one hundred fhares at Taney-town; and that William Emmit, James
Hughes and Chriftian Smith, be and they are hereby appointed for taking one
hundred fhares at Emmitfburgh; and that Nathaniel Rochefter, Jacob Harry
and Thomas Sprigg, be and the are hereby appointed for taking two hundred
and twenty fhares at Elizabeth-town; and that Robert Johnfon, George Clark
and fames Ramfay, be and they are hereby appointed for taking one hundred
fhares at Green Caftle; and that George Hetick, William Alexander and Sa-
muel Riddle, be and they are hereby appointed for taking one hundred and twenty
fhares at Chamberfburgh; and that James Ervin, James Buchanan and Robert
M'Gaw, be and they are hereby appointed for taking fixty fhares at Mefferf-
burgh; and that George Murdock, William M. Beall and George Baer, junior,
be and they are hereby appointed for taking one hundred fhares at Frederick-
town and that James Gettis, Alexander Cabean and Alexander Ruffell, be and

they are hereby appointed for taking one hundred fhares at Gittifburgh; and that

James M'Sherry, Jacob Winderon and Thomas Lilly, be and they are hereby
appointed for taking fixty fhares at Little's-town; and that Jacob Rudecil, Con-
