C H A P.
|
II. Be it enacted, by the General Affembly of Maryland, That the levy court
of Harford county are hereby authorifed and required, at their next levy court,
to appoint five difcreet, fensbible and difinterested perfons, as commiffioners, to
lay-out a public road beginning at a place known by the name of John Neal's
Lane, and to run in a direction fo as to interfect a great road leading to the city
of Baltimore, which paffes by a place known by the name of Cox's Mill to the
Upper Crofs Roads; in the laying out of which public road the faid commif-
fioners are directed to take into view as well the difadvantages which may
refult to individuals over whofe lands the faid road may run, as the convenience
of the public, fo as to lay out the faid road with as little injury to private pro-
perty as will comport with the public convenience.

turned, &c.

III. And be it enacted, That the faid commiffioners are hereby further direct-
ed to return a plot of faid road fo by them laid out to the clerk's office of faid
county, to be there recorded, and the levy court fhall, after the return of faid
plot as aforefaid, appoint a fupervifor or fupervifors to open the fame, and fhall
levy a fum of money, not exceeding one hundred dollars, for that purpofe; and
the faid road, when opened as aforefaid, fhall be taken for, and it is hereby de-
clared to be, a public road in faid county, and may be repaired as other public
roads are repaired in faid county; provided neverthelefs, that nothing herein con-
tained fhall authorife the faid commiffioners to open the faid road, or the levy
court to levy any fum of money for that purpofe, until the affent of every per-
fon through whofe land the faid road may pafs be firft had and obtained under
the hand of every fuch perfon, and returned to the levy court aforefaid; and pro-
vided alfo, that nothing herein contained fhall in any manner authorife the faid
commiffioners to lay out the faid road through the lands of any infant, or perfon
non compos mentis.

IV. And be it enacted, That the commiffioners appointed in virtue of this act,
and the furveyor employed by the faid commiffioners, fhall be entitled to an al-
lowance of two dollars for every day they fhall feverally attend in difcharge of
the duties herein impofed.

C H A P. LXIX.
A Supplement to the act for the better adminiftration of juftice in
the federal counties of this ftate.
Be it enacted, by the General Affembly of Maryland, That upon the death,
refignation, removal out of the diftrict, or other difqualification, of any
chief juftice now in commiffion, or who may hereafter be commiffioned
in virtue of this act, the governor and council fhall and they are hereby autho-
rifed and directed to appoint and commiffion, for fuch diftrict in which the va-
cancy may happen, one perfon of integrity, experience and found legal know-
ledge, who, after his appointment, fhall refide in the diftrict for which he is ap-
pointed, (and who fhall be ftyled in the commiffion Chief Juftice of the county-
courts in fuch diftrict;) and upon the death, refignation, removal to refide out
of the diftrict, or other difqualification, of any affociate juftice commiffioned in
virtue of the act to which this is a fupplement, or who may hereafter be com-
miffioned in virtue of this act, the governor and council fhall and they are here-
by authorifed and directed to appoint and commiffion, in fuch county in which
the vacancy may happen, two perfons of integrity, experience and knowledge,
refidents of the county for which they are appointed, (who fhall be ftyled in the
commiffion Affociate Juftices of the county court of the county for which they
fhall be appointed;) and the faid chief juftice and affociate juftices fhall hold
their commiffions during good behaviour, and may be removed for misbehaviour,
in the fame manner as the chancellor and the judges may be removed agreeably
to the conftitution of this ftate, and not otherwife.

II. And be it enacted, That every chief juftice appointed and commiffioned
in virtue of an act of affembly paffed at November feffion, feventeen hundred
and ninety-fix, entitled, An act for the better adminiftration of juftice in the
