SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 13 of Article 63 of the Annotated Code of Maryland
(1957 Edition), title "Mechanics' Lien", sub-title "In General", be
and it is hereby repealed and re-enacted, with amendments, to read
as follows:
13. In all cases in which a contractor or builder of a [house]
building shall have purchased materials or contracted for work and
the party with whom such contract was made shall have given notice
as required in Sections 11 and 12 to the owner of such building, it
shall be lawful for the owner to retain from the cost of such building
the amount which he may ascertain to be due to the party giving
such notice; and in case any lien be laid by the party giving such
notice and be also laid by the contractor or builder, the said contrac-
tor or builder shall receive only the difference between the amount
due him and that due the person giving the notice.
SEC. 2. And be it further enacted, That this Act shall take effect
June 1, 1962.

AN ACT to repeal and re-enact, with amendments, Sections 3 and
27 (a) of Article 64A of the Annotated Code of Maryland (1961
Supplement), title "Merit System", revising the description of
registrars and librarians at the State teachers' colleges, the Uni-
versity of Maryland and certain other colleges and institutions
which are excluded from the State merit system and from inclu-
sion in State pay plans under the jurisdiction of the State Stand-
ard Salary Board.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sections 3 and 27 i(a) of Article 64A of the Annotated Code
of Maryland (1961 Supplement), title "Merit System", be and they
are hereby repealed, and re-enacted with amendments, to read as
follows:

The following positions shall not be included in the classified serv-
ice, namely: Those held by officers elected by popular vote and offi-
cers whose appointment and election is provided by the Constitution,
including deputy clerks provided for by the Constitution, Article 4,
Sections 26 and 37; officers and employees of the General Assembly
or of either house thereof; officers and employees appointed or desig-
