and of the State Comptroller as the case may be, whose joint deter-
mination shall be final and conclusive.
(e) The Department may place prisoners at labor upon State
works whenever in the judgment of the Department the same shall
be expedient and proper, upon such terms as to it seem wise.

(f) The Department of Correction shall submit annually to the
Governor and the Budget Director a complete financial report and
program of the operation of state use industries and of the so-called
State Use Industries Fund, in the same general manner and form as
for the other operations and programs of the Department of Correc-
tion, including full information as to present and projected personnel
and their compensation; and the Governor and Budget Director shall
include data and figures from the report and program of state use
industries and of the State Use Industries Fund in the preparation
of the Budget and of the Capital Improvement bill.
(g) The Department shall formulate a system of records and ac-
counting which at all times shall indicate the source, nature, and ex-
tent of its purchases, and the source, nature, and extent of its sales.
(h) The Department possesses and enjoys all powers and authority
necessary for the proper performance of any duty or function by
this section devolving upon or required of the Department.
Wardens and Superintendents
682.
(a) A warden or superintendent shall be appointed for each in-
stitution within the Department. He shall be appointed by the
Commissioner, for an indefinite term at the pleasure of the Com-
missioner. He shall be a person with adequate knowledge of penal
and/or reformatory institutions and systems and with executive
experience therein.
(b) Subject to Departmental policy as established from time to
time by the Commissioner, the warden or superintendent is in sole
and direct charge of his institution, and it is his duty to supervise the
government, discipline, and policy of his institution and to enforce
all orders and regulations of the department.
(c) Assistant wardens or assistant superintendents may be ap-
pointed in any institution in which deemed necessary. They shall be
appointed and have the same qualifications as the wardens or super-
intendents and shall perform the duties of warden or superintendent
in the absence of that official. They shall be appointed by the Com-
missioner for indefinite terms at the pleasure of the Commissioner.
