of appropriating for the maintenance of the Municipal Court of Balti-
more City, this Act is hereby declared to be an emergency measure
and necessary for the immediate preservation of the public health
and safety, and having been passed by a yea and nay vote, sup-
ported by three-fifths of all the members elected to each of the two
Houses of the General Assembly of Maryland, the same (a) shall
take effect from the date of its passage; (b) shall terminate or be of
no effect as of the time that, and upon condition that, the aforesaid
Chapter 616 becomes or became effective, otherwise to remain in full
force and effect; and (e) shall not be construed as repealing, by im-
plication or otherwise, the aforesaid Chapter 616, or any part thereof.

CHAPTER 4
(Senate Bill 6)

AN ACT to repeal and re-enact, with amendments, Sections 113(d),
124 and 127 of Article 26 of the Annotated Code of Maryland (1957
Ed. ), Title, "Courts", sub-title, "Municipal Court of Baltimore
City", as the same were enacted by Chapter 616 of the Acts of the
Regular Session of 1961, relating generally to the place of con-
finement for various terms of sentences by said Municipal Court,
deleting the provision for a session of the Court, except the Housing
Part and the Traffic Division, each day of the week in each Police
District, relating generally to the payment of expenses of said
Municipal Court and the Municipal Court Special Fund, and pro-
viding that this Act shall be an emergency measure, conditioned
upon the taking effect of the aforesaid Chapter 616.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sections 113 (d), 124 and 127 of Article 26 of the Annotated
Code of Maryland (1957 Ed. ), Title, "Courts", sub-title, "Municipal
Court of Baltimore City", be and they are hereby repealed and re-
enacted with amendments to read as follows:

113(d). Places of confinement. Except as provided in Sub-sections
(e) and (g) hereof, all sentences of imprisonment (except in default
of fine) for a term of [three] six months or less [may] shall be to the
Baltimore City Jail or to the Maryland House of Correction, in the
discretion of the Judge, and all sentences of imprisonment for over
[three] six months shall be to the Maryland House of Correction.

124. Quarters. [There shall be a session of the court on each day
of the week in each of the police districts in Baltimore City except
the Housing Part and the Traffic Division. ] The Chief Judge, after
consultation with the Mayor and City Council of Baltimore and the
Police Commissioner of Baltimore, shall determine the location of
the various parts and divisions of the Court for which suitable and
