C H A P.
LXX1V.
Clerk to tranf-
mit a lift, &c.

V. And be it enacted, That the clerk of the feveral counties in this ftate
fhall, on or before the tenth day of November annually hereafter, tranfmit to
the treafurer of the weftern fhore a lift of all fuch executions as may be iffued
under the authority of this act, and of the feveral fums of money which the
fheriffs of their respective counties fhall have acknowledged to have been received
by them refpectively for fines, penalties and forfeitures.

VI. And be it enacted, That the feveral fheriffs aforefaid fhall and they are
hereby directed to pay over the cofts arifing from the faid executions to fuch per-
fons as are entitled to and ought to receive the fame.

Preamble.

VII. And be it enacted, That the refpective fheriffs of this ftate fhall be
anfwerable for all fines, penalties and forfeitures, impofed on the inhabitants of
heir refpective counties by the judgment of any court within this ftate, where
no writ of execution fhall iffue for recovery of fuch fine, penalty or forfeiture,
unlefs the faid fheriffs fhall refpectively make it appear, to the fatisfaction of the
treafurer, that the party on whom fuch fine, penalty or forfeiture, was impofed,
was infolvent and unable to pay the fame.

C H A P. LXXV.
An ACT refpecting certain lands lying within this ftate claimed
by Edmund Jenings, Efquire, of the city of London.

WHEREAS the faid Edmund Jenings heretofore held, and ftill claims,
part of a tract of land called Waters's Lot, containing four hundred
and feven acres and three quarters of an acre, and part of a tract of
land called Robin Hood Foreft, containing two hundred acres, the faid lands ly-
ing and being in Anne-Arundel county, and information having been given to
the governor and council, that the faid lands were Britifh property, and confif-
cated to the ftate by the act, entitled, An act to feize, confiscate and appropriate,
all Britifh property within this ftate: And whereas the faid Edmund Jenings,
during the late war between Great-Britain and America, conftantly manifefted
his attachment to the rights of America, poffeffed the confidence of the legifla-
ture of this ftate, and was obliged to depart the kingdom of Great-Britain for
fuch his conduct, and to refide, during part of the faid war, in other countries;

II. Be it therefore enacted, by the General Affembly of Maryland, That the
ftate of Maryland doth hereby releafe to the faid Edmund Jenings, his heirs and
affigns, all right, title, intereft and claim, (if any,) that the ftate hath or may
have in and to any of the lands and premifes aforefaid.

Provifo.

III. Provided always, That nothing herein contained fhall in any manner
affect or defeat the right, (if any,) of the informer, in cafe he fhall think proper
to profecute the fame under any of the exifting laws of this ftate within two
years next after the paffing of this law; and fuch informer is hereby empowered,
at any time within the faid term of two years, to commence a fuit in the court
of chancery againft the faid Edmund Jenings, his heirs or affigns, for the reco-
very of the value of the intereft of the laid informer, wherein the chancellor, in
cafe the right of fuch informer be eftablifhed, may decree a fale of the faid par-
cels of land, or any part thereof, to fatisfy the claim of the faid informer, and
may make fuch order in the premifes as in juftice and equity fhall feem right and
proper, to afcertain the value of the intereft aforefaid of fuch informer.

C H A P. LXXVI.

Paffed De-
cember 24.

An ACT refpecting a tract of land lying within this ftate claimed
by Thomas Digges, Efquire, of the kingdom of Great-
Britain.

Preamble.

WHEREAS information was given to the executive of this ftate in the
year feventeen hundred and ninety, under a law of this ftate, by
Benjamin Brookes, of Prince-George's county, of and concerning
