for their infpection and examination; and the governor and council, after having
received the returns, papers and inftruments aforefaid, fhall enumerate and afcer-
tain the number of votes for each and every candidate and perfon fo as aforefaid
polled and voted for as an elector refpectively, and fhall thereupon declare, by
proclamation figned by the governor, and without delay difperfed through the
ftate, the name of the perfon duly elected as elector in each refpective diftrict.

C H A P.
LXXIII.

VI. And be it enacted, That the electors, fo as aforefaid to be chofen, fhall
affemble on fuch day as the congrefs of the United States have or fhall hereafter
from time to time determine and appoint, at the city of Annapolis, and fhall
then and there perform the duties enjoined upon them by the conftitution of the
United States, agreeably to the directions thereof.

VII. And, whereas it may happen, that in the election of the faid electors two
or more of the faid candidates may have an equal number of votes, Be it enact-
ed, That in fuch cafe the governor and council fhall determine, by lot, from the
candidates who fhall have an equal number of votes as aforefaid, who fhall be
the elector for the faid refpective diftricts.

VIII. And be it enacted, That all acts, or parts of any former acts of this
ftate, repugnant to or inconfiftent with the provifions hereof, fhall be and the
fame are hereby declared to be repealed.

C H A P. LXXIV.

Acts, &c. re-
pealed.

An ACT for the more fpeedy and effectual recovery of fines,
penalties and forfeitures.

WHEREAS doubts are entertained whether, under the exifting laws of
this ftate, a writ of capias ad fatisfaciendum can be iffued for the re-
covery of any fine, penalty or forfeiture; for remedy whereof,

Preamble.

II. And be it enacted, by the General Affembly of Maryland, That it fhall and
may be lawful for the attorney-general of this ftate, or either of his deputies,
ex-officio, and they are hereby directed and required, on the application of the
fheriffs of the refpective counties in this ftate, to order a writ or writs of capias
ad fatisfaciendum to be iffued for the recovery of all fines, penalties and for-
feitures, which have or hereafter may be impofed by any court of record in this
ftate, together with the cofts accruing thereon.

III. And be it enacted, That all fines, forfeitures and penalties, together with
cofts due on the fame, fhall hereafter be paid to the feveral and refpective fheriffs
to whom any fuch writ of capias ad fatisfaciendum fhall be directed, who fhall,
on or before the tenth day of November annually hereafter, pay over to the
treafurer of the weftern or eaftern fhore on which they fhall refpectively refide,
all fuch fums of money, except the cofts, as they fhall have refpectively received
on account of the fame.

IV. And be it enacted, That it fhall be the duty of the feveral and refpective
fheriffs to whom fuch writs of capias ad fatisfaciendum fhall be directed, to re-
turn the fame to the courts to which they fhall be made returnable, at the term
next fucceeding the iffuing of the fame; and whenever the fheriff to whom fuch
writ or writs fhall be directed, fhall make return that he has taken the body or
bodies of the perfon or perfons againft whom fuch writ or writs fhall have iffued,
fuch fheriff fhall be obliged, either to acknowledge in open court the receipt of
the full amount of fuch fines, forfeitures and penalties, with the cofts due there-
on, for the recovery of which fuch writ or writs fhall have iffued, or to produce
the body of every fuch perfon who fhall have been fo taken by him to the court
to which the faid writ fhall be returned, and in default thereof, the faid court,
upon motion of the attorney-general, or of his deputy, fhall order judgment to
be entered up againft fuch defaulting fheriff for the amount of the fame and
