CHAP.
LXI.

IX. And be it enacted, That the faid examiner and regifter, fhall be entitled to
the like fees of office for their refpective fervices as are now, or may from time
to time, be allowed by law to the examiner and regifter of the land-office for the
weftern fhore for the like fervices, and the faid regifter fhall alfo be entitled to
fuch fees for iffuing fubpoenas and attachments out of the faid land-office, as are
allowed for fubpoenas and attachments iffued out of the court of chancery.

X. And be it enacted, That the feveral acts of affembly now in force for the
government of land affairs, and of the refpective officers concerned therein, on
the weftern fhore, fhall be and they are hereby declared and adjudged to be in
force and of full effect for the government of land affairs, and of the refpect-
ive officers concerned therein, on the eaftern fhore, except fo much thereof as is
virtually altered by this act.

XI. And be it enacted, That common or fpecial warrants may iffue from the
land-office on the eaftern fhore for any deficiency in any grant, on fuch deficiency
appearing on a certificate of refurvey, and alfo in the cafe of caution money paid,
and the grant or certificate vacated; provided, that no warrant fhall iffue for any
fuch deficiency upon any grant or certificate which fhall be iffued or made before
the firft day of March next, until a certificate fhall be obtained from the regifter
of the land-office of the weftern fhore, and produced to fuch regifter on the
eaftern fhore, that no warrant has been before iffued for fuch deficiency, or any
part thereof, nor the party under whom he claims in any manner fatisfied for the
fame, as far as appears by the records of his faid office.

XII. And be it enacted, That the regifter of the land-office on the eaftern
fhore may iffue fubpoenas, to fummon parties to appear before the judge of the
faid land-office to maintain or anfwer any caveat, or to require the attendance of
any witneffes to give teftimony on any caveat, provided there be not lefs than fif-
teen days between the date of the fubpoena and the day of the return thereof;
and every fheriff fhall obey fuch fubpoena, and, on return thereof, attachment
for contempt fhall be iffued by the faid regifter againft any witnefs who fhall not
attend, and the judge of the laid land-office may fine fuch witnefs for non at-
tendance, as in cafes of attachments iffued out of the, general court; and every
witnefs fhall have the fame allowance for his attendance, and itinerant charges,
as on fubpoenas out of the general court, and may compel the party, at whofe re-
queft he is fummoned, to pay him the fame, either by attachment out of the coun-
ty court of the county wherein the perfon indebted refides, or by warrant before
a juftice of the peace, if under ten pounds current money; and the judge of the
faid land-office may compel the perfon againft whom he fhall determine on the
caveat to pay all the legal cofts attending the fame, and may alfo by rule, direct
any depofition to be taken, and received as evidence before him on the hear-
ing of any caveat, provided reafonable notice in fuch order be given to the other
party.

An ACT for erecting a bridge over the Eaftern branch of Patow-
mack river.

WHEREAS it is reprefented to the general affembly, by the petition of
Notley Young, Daniel Carroll, of Duddington, Thomas Law, Wil-
liam Mayne Duncanfon, George Walker and Matthew Wigfield, that
they, together with others, are defirous of forming a company for the purpofe of
erecting a bridge over the Eaftern branch of the Patowmack river, from the
lower end of Kentucky avenue, in the city of Washington, to the land of Mat-
thew Wigfield: And whereas this general affembly approve the meafure, which,
if effected, will greatly tend to the benefit and convenience of the citizens of this
