C H A P. LI.

Paffed De-
cember 24.

An ACT for enlarging the capital of this ftate in the Patowmack
Company.

Treafurer to
fubfcribe, &c.

Be it enacted, by the General Affembly of Maryland, That the treafurer of
the weftern fhore of this ftate be and he is hereby authorifed and directed
to fubfcribe, in behalf of this ftate, forty fhares in the augmented capital
of the Patowmack Company, and to pay the fum of five hundred and feventy-
feven dollars and feventy-eight cents on each of faid fhares; and the faid treafurer
fhall receive the proportion of tolls which fhall from time to time be due to the
ftate for faid fhares, and the faid treafurer fhall have a right to vote for faid
fhares in perfon, or by proxy appointed by him.

But not until
notified by
the prefident,
&c.

II. And be it enacted, That the treafurer fhall not fubfcribe for any fhare in
the faid company until the prefident thereof fhall notify to him, in writing, that
the whole of the refidue of the faid fhares are fubfcribed for; and the payment of
the fhares fubfcribed for by the treafurer fhall be made at the times and in the
proportion required of the individual ftockholders in the faid augmented capital.

Preamble.

An ACT authoring the laying out certain roads in Worcefter
county.
WHEREAS it is reprefented to this general affembly, by the petition of
fundry inhabitants of Worcefter county, that the laying out a road
from the Locuft landing to interfect the main road leading from
Snow-Hill to Philadelphia, as alfo another road from William Davis's fhop to
Cornelius Ennis's landing, would be of general public advantage ;

II. Be it enacted by the General Affembly of Maryland, That Meffieurs Jofhua
Prideaux Edward Henry, George Purnell, William Purnell and Littleton Robins,
be and they are hereby appointed commiffioners; and the faid commiffioners, or a
majority of them, are hereby authorifed to open and clear, at leaft twenty feet wide,
the faid roads, in the manner following, viz. The faid firft mentioned road from
the faid Locuft landing to interfect the road leading from Snow-Hill to Philadel-
phia, and the faid laft mentioned road from the faid William Davis's fhop to the
faid Cornelius Ennis's landing, and the faid roads, fo opened and cleared (after
the valuation herein after directed to be made, or the damages herein after direct-
ed to be affeffed fhall be paid, or fecured to the individuals concerned,) fhall be
recorded among the records of Worcefter county, and fhall for ever thereafter be
deemed a public road, and fhall be kept in repair in the fame manner as other
public reads are kept in the faid county.

Who fhall af-
certain the
damages, &c.

III. And be it enacted, That the commiffioners aforefaid, or a majority of
them, fhall afcertain and value what damages may be fuftained by any perfon or
perfons through whofe lands the faid roads may pafs by opening and clearing the
fame and the faid valuation fhall be made and paid before the commiffioners
fhall proceed to open and clear the fame; and in cafe any proprietor or proprie-
tors fhall conceive him, her or themfelves aggrieved by the valuation of the faid
commiffioners, or fhall be an infant, feme-covert, or non compos mentis, it fhall
and may be lawful for the faid commiffioners, on the application of any perfon
interefted to apply to any juftice of the peace for the county of Worcefter, who
fhall thereupon iffue his warrant, under his hand and feal, to the conftable of
the hundred wherein fuch lands may be, commanding him to fummon twelve
freeholders, difinterefted in the faid road, to appear on a day by him to be ap-
pointed on the faid lands, at which time fuch freeholders fo fummoned fhall
refpectively appear before fuch juftice, and take the following oath, or affirmati-
on, viz. "I, A. B. do fwear, or affirm, that I will honeftly value the damage
" and injury fuftained by C. D. by opening a road through the lands of the faid
" C. D. in purfuance of this act;" and fhall return an inquifition of fuch da-
mages by them affeffed to the clerk of the county court of Worcefter, and the
damages fo affeffed fhall be conclufive.
