C H A P. XXV.

1795.

An ACT for the prefervation of the navigation of Dividing creek.

WHEREAS it is reprefented to this general affembly, that wears have,
of late, been erected in and upon Dividing creek, in Worcefter and
Somerfet counties, and trees have been fell in and acrofs faid Dividing
creek, to the great injury of the navigation of faid creek ;

Preamble.

II. Be it enacted, by the General Affembly of Maryland, That all wears alrea-

dy made, or hereafter to be made, in faid creek, and all trees now acrofs or in

faid Dividing creek any where below where the tide is known to run flood, fo as
to flop the paffage of fcows or timber, fhall be deemed, and are hereby declared,
nuifances, and may be, by any perfon, taken out of faid Dividing creek and de-
ftroyed as fuch.

III. And be it enacted, That no perfon or perfons fhall, after the firft day of
March next, put, place or make, any wear, or fall a tree or trees acrofs or in faid
Dividing creek, fo as to flop the paffage of fcows or timber, as the cafe may be,
any where in faid creek where the tide is known to run flood, under the penalty
of ten pounds current money for every fuch offence, to be recovered by action of
debt in the county court of the county in which the offence may have been
committed, one half to the informer, or perfon who will fue for or profecute to
effect for the fame, the other half to the ufe of the county where fuch offence
may be committed, to be applied towards the improvement of the navigation of
the faid creek, any law to the contrary notwithstanding.

C H A P. XXVI.

No perfon to
put up any
wear, &c.

An ACT to confirm the title of Nathaniel Andrews and Hum-
phrey Buckler to a lot of ground in Baltimore-town.

WHEREAS Nathaniel Andrews and Humphrey Buckler, of Balti-
more county, by their petition to this general affembly, have ftated,
that they, together with William Cole, a citizen of this ftate, pur-
chafed of Charles Carrol], of Carrollton, Efquire, part of a lot of ground in
Philpott's addition to Baltimore-town, and obtained a conveyance therefor on the
twenty-third day of October, feventeen hundred and ninety-five; that the faid
Andrews and Buckler, at the time of the execution of the faid conveyance, were
not naturalized, but have fince become citizens of this ftate by taking the oaths
required by law, and have prayed a confirmation of their title to the faid lot of
ground; and the facts ftated in the faid petition appearing true,

II. Be it enacted, by the General Affembly of Maryland, That the faid Na-
thaniel Andrews and Humphrey Buckler fhall be, and they are hereby declared
to be, competent to hold the faid lot of ground, and fhall ftand and be feized of
fuch eftate and intereft therein, under and by virtue of the faid conveyance, as
they would refpectively have been entitled to in cafe they had been naturalized as
citizens of this ftate before the execution of the faid conveyance.

C H A P. XXVII.

firmed.

An ACT to eftablifh a bank, and incorporate the fubfcribers
thereto.

Be it enacted, by the General Affembly of Maryland, That a bank fhall be
eftablifhed at Baltimore-town, the original capital flock whereof fhall
not exceed one million two hundred thoufand dollars, and fhall be divided
into fhares of three hundred dollars; and the fubfcriptions towards conflicting
the faid flock fhall, on the firft Monday of June next, be opened at Baltimore-
town for twelve hundred and forty fhares, under the fuperintendence of Meffieurs
David Steuart, William Winchefter, Thorowgood Smith, William Wilfon,
Archibald Steuart, George Salmon, James Weft, Thomas Ufher, junior, Henry
Payfon, Thomas Hollingfworth, Nicholas Rogers, Elias Ellicott, Jofeph Swan,
Andrew Buchanan, Solomon Etting, Charles Ghequiere, Hugh M'Curdy and
Chriftopher Johnfon; at Belle-Air, in Harford county, for one hundred and
