XXII.

IV. And be it enacted, That after the faid road and landing are laid off, and
when the fame fhall be confidered by the faid commiffioners as fit for ufe, it
fhall be lawful for the faid Jacob Loockerman, his heirs or affigns, to flop up
the old road which at prefent runs through the faid Loockerman's land as above

ftated.

C H A P. XXIII.

cember 23.

An ACT refpecting executions iffued from one county to another,
and to compel the attendance of witneffes fummoned from one
county to another.

be proceeded
on, &c.

Be it enacted, by the General Affembly of Maryland, That in all cafes where
any execution has been, or fhall be fent, with an attefted fhort copy of
the judgment whereon the fame may have been iffued, from one county to
another, according to the provifions of the act paffed at October feffion, feven-
teen hundred and feventy-feven, entitled, An act to empower the county courts
to iffue fubpoenas for witneffes refiding in other counties to attend trials to be
had before fuch courts, and to direct the manner of iffuing executions from one
county to another, and of the act paffed at November feffion, feventeen hundred
and ninety-four, entitled, An act for the amendment of the law in certain cafes,
the fame proceedings fhall and may, upon the return of fuch execution, be had
thereon in the county court of the county to which fuch execution has been, or
fhall be fent, as if the faid execution had been originally iffued by the faid court
on a judgment obtained therein, and the fame execution may, if neceffary, be
renewed from time to time in virtue of fuch attefted fhort copy of the judgment
out of the county court to which fuch original execution fhall have been returned,
and be proceeded upon in like manner as if the judgment in fuch cafe had been
rendered therein.

II. And be it enacted, That in all cafes of attachment to be iffued by any
county court, in virtue of the aforefaid act paffed at October feffion, feventeen
hundred and feventy-feven, upon the non-attendance of any witnefs fummoned
from another county, it fhall be the duty of the fheriff to whom fuch attachment
fhall be directed, and he is hereby authorifed and required, to make return there-
of to the county, court by which the fame fhall be iffued, and if the party be
taken thereon, to produce fuch party before the faid court, to abide their fentence
thereupon.

C H A P. XXIV.

cember 24.

An ACT to revive and make valid the proceedings of the levy
court of Kent county.

Preamble.

WHEREAS the juftices of the levy court of Kent county neglected to
meet on the day on which the faid court ftood laft adjourned to;
therefore,

tices to meet
&c.

II. Be it enacted, by the General Affembly of Maryland , That any five juftices
of the peace of Kent county be empowered to meet, at any time after the paffage
of this act, at the court-houfe in Kent county, for the purpofe of fettling the
levy of faid county, and to tranfact all other matters and things within the jurif-
diction of faid court, in as ample and full a manner as they could have done had
they met on the day to which the faid court ftood adjourned; and all tranfactions
by them done, fubfequent to the time when the faid court ftood adjourned, are
hereby confirmed and made valid in law, any law, ufage or cuftom, to the con-
trary notwithftanding; provided, that ten days previous notice be given by the
clerk of the county of the time of fuch meeting, by advertifement fet up at the
court-houfe door, and other public places.
