roads, as foon as the fame are payable by law to the faid juftices, and in cafe of
negled or refufal in the faid colledor to fettle and pay the fame, the faid juftices
shall and they are hereby authorifed, directed and required, within two months
thereafter, to iffue an execution againft the faid collector or collectors, out of the
county court, for the fum of money fo due from the faid colledor or collectors,
and fhall have all the legal benefits and privileges ufually attending executions
iffued in behalf of the ftate of Maryland; and the faid juftices of the levy court
fhall alfo liquidate and fettle the accounts of all the fupervifors within their coun-
ty annually at their levy courts; and the faid juftices fhall keep a fair record of
all their proceedings relative to the public roads.

CHAP.
LII.

XIV. And be it enacted, That if any perfon or perfons fhall alter or change,
or in any manner obftrud or encroach upon, any of the faid roads, or on any part
or parts thereof, or cut down, deftroy or injure, any of the bridges, caufeways,
boundaries, marks or directions, therein or thereon, fuch perfon or perfons, be-
ing thereof convicted in the county court, fhall be fined at the difcretion of the
court for each and every fuch offence, in any fum not exceeding fifty pounds, ac-
cording to the nature and degree of the offence; and all fines impofed in fuch
cafes fhall be appropriated to the purpofe of repairing fuch damages, and im-
proving the roads in the county where the offence is committed, and fhall be paid
to, and accounted for by, the fupervifor of the diftrid wherein fuch damages
fhall be fuftained.

XV. Whereas the money to be raifed under this act will not be fufficient to keep
the public roads in Allegany county in good repair; therefore, Be it enacted,
That the fupervifor of the public roads in faid county be and he is hereby autho-
rifed and directed to fummon or warn every free able-bodied male perfon, and alfo
the mafter or miftrefs of any male fervant, above the age of fixteen years, in his
diftrid, to affift in repairing the public roads in faid diftrict, and every perfon
who fhall refufe or negled fhall forfeit the fum of ten fhillings current money;
and every mafter or miftrefs as aforeiaid, who fhall refufe or negled to fend all
his or her male fervants of the age aforefaid, fhall forfeit for each perfon the fum
of ten thill ings current money; provided neverthelefs, that it fhall and may be
lawful for every perfon who fhall be fummoned or warned under this act, and for
every mafter or miftrefs of fervants as aforefaid, in lieu of working on the public
roads as aforefaid, to pay to the fupervifor of the faid diftrid the fum of three
fhillings and nine-pence current money for each and every day any perfon fhall
be fummoned or warned to work as aforefaid.

XVI. And be it enacted, That the fupervifor of the public roads in faid coun-
ty who fhall refufe or negled to fummon every free able-bodied male perfon, or
the mafter or miftrefs of any male fervants as aforefaid, who fhall refufe or negled
to recover the fine or fines by this act impofed on any perfon for not affifting in
repairing the public roads, fuch fupervifor fhall, for every perfon whom he fhall
not fummon or warn as aforefaid, and for every perfon from whom he fhall
negled to recover the fine or fines as aforeiaid, forfeit and pay the fum of ten
fhillings current money for every fuch offence; provided, that nothing in this
act contained fhall authorife any fupervifor to fummon or warn any perfon above
four days in each and every year, and any perfon fummoned or warned for more
than the faid four days, fuch perfon fhall not be obliged to attend more than the
faid four days.

XVII. And be it enacted, That if any perfon or perfons fhall, on or before
the firft day of September annually, pay to the fupervifor of the public roads of
the diftrid in which fuch perfon or perfons fhall refide, the fum or fifteen fhil-
lings current money for each and everv perfon liable to affift in the repairing the
public roads in faid county, iuch perfon or perfons fhall not, for one year from
the day on which fuch payment or payments is or are made, be liable to the
penalties of this act, and the fupervifor fhall not be obliged to fummon fuch per-
fon or perfons, any thing in this act to the contrary notwithftanding.
