LAWS of MARYLAND.

CHAP.

LII.

purchafe, fuch wood, timber, and other materials, as may be neceffary in making
fuch bridges and caufeways.

Warrants to
be made out
by the clerk,
&c.

VIII. And be it enacted, That the warrants fhall be made out to the fuper-
vifors as aforefaid by the clerks of the faid courts, and by them delivered to the
fheriffs of the counties within ten days after the faid warrants fhall be ordered by
the faid courts, and fhall be delivered by the faid fheriffs to the fupervifor to
whom the fame is directed within ten days after the faid fheriffs receipt thereof,
under the penalty of five pounds for each warrant ordered and not delivered by
the clerk, and the like fum for each warrant received and not delivered as afore-
faid by the faid fheriff, to be recovered before a fingle magiftrate as in cafe of
fmall debts out of court, and applied towards clearing and amending the public
roads, bridges and caufeways, aforefaid.

IX. And be it enacted, That if any of the faid fupervifors fhall not well and
fufficiently clear and amend the faid public roads within his diftrict, within a
reafonable time after the fame fhall be out of repair, or fhall not ftreighten the
faid public roads, as marked and bounded by the commiffioners, agreeably to the
provilions of this act, or fhall permit or fuffer any fallen trees, or other obftruc-
tion, within his power, to remain in or acrofs any of the faid public roads,
whereby any waggon, cart or other carriage, may be obftructed for the fpace of
two days together, he having notice thereof, or fhall neglect to fall, or caufe to
be fallen, all dead trees on either fide of the faid public roads, whofe limbs hang
over the fame, or any of them, and may by their falling injure travellers, or lop
or cut off all limbs or branches of trees hanging or projecting over the road,
within fifteen feet above the furface thereof, or fhall fuffer any of the bridges or
caufeways which he is bound to repair by this act in his faid diftrict to be out
of repair, or in any other manner fail to perform the duties of a fupervifor of the
public roads within his diftrict, after having accepted fuch office, he fhall for-
feit and pay a fum not exceeding five pounds current money lor every fuch of-
fence, to be recovered and applied as aforefaid.

Who fhall not
be anfwerable
for fines, &c.

X. Provided always, and be it enacted, That no fupervifor fhall, in any in-
ftance, be anfwerable for the fine or fines by this act impofed, where it can be
made appear that the neglect of fuch fupervifor happened after the fum appro-
priated to the road or roads of which he is fupervifor had been applied and ex-
pended under the direction of the courts aforefaid.

They may

ftones, &c.

XL And be it enacted, That it fhall and may he lawful for the fupervifors
aforefaid, and any perfons to he employed by them, to take and carry away any
ftones, gravel, or earth of a firm quality, that may be found on any land adjoin-
ing the roads for which the fame may be wanted, without leave of the owner, or
making him any compenfation therefor; provided, that no flone, quarried or col-
lected by the owner for his own ufe, or for faie, fhall be fo taken or applied, or
any enclofure faid open to obtain the fame, without leave of the owner or owners
firft being obtained.

And fhall
give notice,
&c.

XII. And be it enacted, That the faid fupervifors fhall and they are hereby
required, before they begin to ftreighten, amend or repair, any road within their
feveral and refpective diftricts, or to make or repair any bridge or caufeway, to
give notice, by advertifement fet up at the moil convenient public and frequented
places in fuch diftrift, in order that the faid inhabitants may have an opportunity
of hiring labourers to the faid fupervifor, or labour themfelves in and upon the
fiid roads, bridges or caufeways; and each fupervifor fhall be allowed fuch fum,
not exceeding feven fhillings and fix-pence for every day, for his labour, trouble
and expence, in fupervifing the making, mending, widening or repairing, the
faid roads, bridges and caufeways, as fhall be deemed reafonable and proper by
the juftices of the levy court.

Juftices to call
on collectors.

XIII. And be it enacted, That the juftices aforefaid may and fhall call upon
the collector or collectors for all monies levied and affeffed for the ufe of the faid
roads,
