LII.

Supervifor to
lay out mo-
nies, &c.

XVIII. And be it enacted, That the fupervifor fhall and he is hereby autho-
rifed and empowered to lay out the monies, or any part thereof which by this
act he may receive from any perfon or perfons, in the fame manner he is autho-
rifed to difpofe of the money levied for repairing the public roads by this act.

And render
an account.

XIX. And be it enacted, That the fupervifors of the public roads in faid
county be and they are hereby directed to lay before the levy court of faid county,
on their annual meeting, an account on oath of the receipt and expenditure of
the money received and expended by this act.

How fines are
to be recover-
ed, &c.

XX. And be it enacted, That all fines and forfeitures by this act impofed,
under the fum of ten pounds current money, fhall be recovered in the fame man-
ner as fmall debts are recoverable out of court; and every juftice of the peace in
the faid county, before whom any of the fines by this act impofed fhall be re-
covered, fhall and he is hereby directed to lay a particular account of the fame
before the juftices of the next fucceeding levy court.

Operation
fufpended.

XXI. And be it enacted, That the operation of this act in Allegany county
fhall be and the fame is hereby fufpended until the firft Monday in Auguft, in
the year feventeen hundred and ninety-fix.

Commence-
ment, &c.

XXII. This act to commence on the firft Monday of March next, and con-
tinue in force three years, and until the end of the next feffion of affembly which
fhall happen thereafter; and from and after the firft Monday of Auguft next, the
act, entitled, An act for the marking of highways, and making the heads of rivers,
creeks, branches and fwamps, paffable, paffed at September feffion, feventeen
hundred and four, and the feveral fupplements thereto, and alfo an act, entitled,
An act for repairing public roads in this province, fhall ceafe and be void, fo far
as they relate to the counties within this act mentioned; and the- act to empower
the juftices of Caecil county to ftreighten and amend the public roads in faid
County, and to levy the expences attending the fame on the affeffable property of
faid county, paffed November feffion, feventeen hundred and ninety-one, except
fo far as relates to the roads already faid out by the commiffioners of faid county,
fhall ceafe to be in force, and are hereby repealed; provided always, that no new
road already faid out by the juftices of the levy court of Caecil county fhall be
opened through any buildings, enclofed yard, garden or orchard, againft the con-
fent of the owner or owners thereof.

This act not
to alter for-
mer laws, &c.

XXIII. And be it enacted, That nothing in this aft contained fhall extend to
alter, or in any manner be conftrued to alter, change or repeal, an act, entitled,
An act for laying out fundry turnpike roads in Baltimore county, and the fupple-
mentary acts thereto, and fo much of an act, entitled, An act to ftreighten and
amend the feveral public roads in feveral counties, as relates to Baltimore county,
or any part thereof, or to deftroy, divert or withdraw, the funds, or any part
thereof, appropriated by law to the purpofes in the faid acts mentioned and ex-
preffed, or in any manner to alter the roads therein mentioned to be ftreightened
or faid out.

How certain
monies, ate to
be difpofed of.

XXIV. And be it enacted, That all monies arifing on the affeffable property
in the town of Frederick, and its additions, in Frederick county, in virtue of this
act, fhall be difpofed of as follow: One third thereof to the public roads of the
county, the other two thirds to be applied to the repairs of the ftreets and alleys
in faid town, agreeably to an act, entitled, An act to repair and amend the ftreets
and alleys in Frederick-town, and for other purpofes therein mentioned.

An act repeal-
ed.

XXV. And be it enacted, That an act, entitled, An act to repair the public
roads in Queen-Anne's county, paffed November feffion, feventeen hundred and
ninety-three, fhall be and hereby is repealed,
