Harry and Matthias Need, and their fucceffors, by the faid act of April, feven-
teen hundred and eighty-three, be and the fame are hereby transferred to, and in-
vefted in, the commiffioners of Elizabeth-town.

III. And, whereas by the faid act of April, feventeen hundred and eighty-
three, no provifion is made for paying the clerk of the faid market any compen-
fation for his trouble, by reafon whereof no perfon will act in the faid capacity,
whereby the inhabitants of the faid town are deprived of all the advantages of

the provifions in faid act refpecting the duties of the clerk; Be it enacted That
the commiffioners of Elizabeth-town, or a majority of them, be and are hereby
inverted with fufficient powers, and it is hereby declared to be their duty, to let
the ftalls and ftands in or about the market-houfe in faid town to butchers or
others, at the beft yearly rent that can be got for the fame, taking fecurity for
the payment thereof; to inquire into the payment and application of the rents of
the faid ftalls and ftands fince the faid market was eftablifhed; and if any perfon
or perfons be in arrear for the faid rents, to whom ftalls or ftands were letten, or
if any perfon or perfons, heretofore in the receipt of the faid rents, have any fum
of the fame in his or their hands unapplied, to compel payment thereof, and to
apply fuch rents and arrearages, if any, together with all fines and forfeitures that
fhall be incurred by virtue of this act, or the act to which this is a fupplement,
towards paying the clerk of the faid market a falary not exceeding twenty pounds
current money per annum, to be afcertained by a majority of the faid commiffi-
oners, for the faithful performance of his duty, and to apply the refidue, if any,
in repairing the faid market-houfe; and in cafe the faid rents, arrearages, fines
and forfeitures, fhall not be fufficient for the purpofes aforefaid, that then the faid
commiffioners apply as much of the money to be levied on the taxable property
of faid town, in virtue of the faid act of November, feventeen hundred and
ninety-one, as will make up the deficiency.

IV. And, whereas the inhabitants of faid town, as well as country people
coming to the faid market to fell provifions, labour under many inconveniences
on account of no regular market hour being; eftablifhed for the faid market to

commence at, Be it enacted, That the faid commiffioners are hereby empowered
to afcertain and fix upon a proper hour or time to open the faid market; provided,
that one month's notice thereof be given by advertifement fet up at the market-
houfe, and that this act, and fuch notice, be alfo published the fame length of
time in the Washington Spy, in the Englifh and German languages, before any
perfon or perfons fhall be affected by the fame, and the clerk of the market fhall
alfo give notice of the commencement thereof, each market day, by ringing the
market-houfe bell for ten minutes next before the time, and any perfon or perfons
that fhall buy or fell any provifions, or other article brought to the faid market for
fale, (except as is excepted in the fourth fection of the act to which this is a fup-
plement,) before the ringing of the bell fhall be over, fhall forfeit respectively for

the fame the fum of ten fhillings current money for each offence.

Time to be
fixed, &c.

V. And be it enacted, That the clerk of the faid market fhall be appointed by
a majority of the faid commiffioners, and removable by them at pleafure for mif-
conduct or neglect of duty; and it fhall be his duty to try, by ftandard, the weight
of butter, and fuch other articles of provifion as are generally brought to mar-
ket made up at a ftated weight, and if they fhall be found deficient in weight,
unfound or unwholefome, to feize and fell the fame to the higheft bidder, and to
pay the money arifing from fuch fale to the commiffioners; and inftead of feizing
blown meat for the ufe of the prifoners in Wafhington county gaol, as is pro-
vided by the faid act of feventeen hundred and eighty-three, the clerk fhall feize
and fell the fame to the higheft bidder, and pay over the price thereof to the
commiffioners; all which fums fhall be by them applied as is directed by the
third fection of this act.

VI. And be it enacted, That all fines, forfeitures and penalties, impofed by
this act, or the act to which this is a fupplement, fhall be recovered by warrant,
before any juftice of the peace for Wafhington county, or of the county where
