LAWS of MARYLAND.

C H A P.
LIX.

Commiffion-
ers appointed,

&c.

II. Be it therefore enacted, by the General Affembly of Maryland, That John
Eager Howard, John O'Donnell, William Smith, Harry Dorfey Gough, Samuel
Owings, of Samuel, Charles Ridgely, of William, Daniel Bowley and Andrew
Robinfon, or a majority of them, be and they are hereby appointed commiffion-
ers, with full power and authority in them vefted, to purchafe, in fee-fimple, or
for a term of years, a quantity of land, not exceeding ten acres, in or near to
Baltimore-town, and the fame land to lay out into fmall and convenient lots,
with proper enclofures and flails, for the reception of cattle, and to hold a mar-
ket thereon, as hereafter provided; which faid land, when obtained, fhall be held
by the commiffioners aforefaid, and their fucceffors, in truft, for the purpofes in
this act contained.

III. And be it enacted, That from and after the firft day of May next, one
day in every week, to wit, Thurfday, fhall be held as a market-day at the faid
market-fpace, and the commiffioners aforefaid may moreover eftablifh as market-
days two or more days in each year, for holding a general market in the faid mar-
ket-fpace, and all horfes, fheep, hogs, and live cattle of every kind, that may be
brought to the faid town, and that may be for fale on any of the faid market-
days, fhall be carried to the faid market-fpace to be fold.

IV. And be it enacted, That no perfon fhall buy or fell, or caufe to be bought
or fold, from or to any perfon or perfons within three miles of the faid town of
Baltimore, any horfe, live cattle of any kind, fheep or hogs, driving to market
upon market-days, at any place whatfoever but at or in the faid market-fpace,
under the penalty of eight dollars for every fuch offence, to be recovered from
fuch purchafer or feller feverally, for the ufe and in the name of the informer,
before a fingle magiftrate, as fmall debts are by law directed to be recovered.

V. And be it enacted, That on the death, removal from Baltimore county, or
refignation of any of the faid commiffioners, the major part of the remaining
commiffioners fhall appoint another to ferve in the ftead of fuch commiffioner fo
dying, removing or resigning.

A clerk to be
appointed,
&c.

VI. And be it enacted, That the faid commiffioners, or a major part of them,
fhall have full power to appoint a clerk of the faid market, and from time to time
to make rules, ordinances and by-laws, for the ordering and governing the faid
market, fo that the fame contain nothing contradictory to what is herein con-
tained, or to the laws of this ftate.

for ftalls, &c.

VII. And be it enacted, That the faid commiffioners, or a major part of them,
fhall be and they are hereby empowered to demand and receive a reafonable com-
penfation for the faid flails and apartments, which fhall be applied to defray the
expences arifing from regulating the faid market in the firft place, and the furplus
may, from time to time, be appropriated for premiums, under the difcretion of
the commiffioners, or a major part of them, for the encouragement of fuch per-
fons as fhall raife or bring to market the fatteft and beft cattle, and other flock.

Duration.

VIII. This act to continue for feven years, and to the end of the next feffion
of affembly which fhall happen thereafter.

C H A P. LX.
An ACT for the recovery of certain amerciaments, and alfo upon
defaults on execution in criminal proceedings.

Be it enacted, by the General Affembly of Maryland, That in cafe any fheriff
or coroner fhall be called upon by the juftices of any court to bring before
them any perfon or perfons before arrefted by fuch fheriff or coroner, ac-
cording to his return of or upon any writ, being either mefne procefs or of exe-
cution, in any criminal proceeding, or upon any recognizance, and fhall fail, ne-
glect or omit, to bring into court fuch perfon or perfons, and therefore fhall be
amerced by the juftices aforefaid, or have his default entered, then and in either
