C H A P.

LXI.

trate of Prince-George's or Montgomery counties, or aldermen of the corporation
of George-town, as the cafe may require, one half to the informer or perfon who
will fue for or profecute to effect for the fame, the other half to the ufe of this
ftate;

IV. And be it enacted, That any perfon or perfons who fhall fifh any fuch
weir or hedge already erected, or which fhall hereafter be erected, fhall forfeit
and pay, for every fuch offence, the fum of five pounds current money, to be
recovered and applied as herein before directed.

C H A P. LXII.

Paffed De-
cember 13.

An ACT to authorife and empower the chief juftice, or affociate
juftices, of any county court, to call a court before the time
to which the fame ftands adjourned.

Preamble.

WHEREAS feveral of the county courts within this ftate ftand adjourned
until the day of the courts in courfe: And whereas by law the
juftiees of the faid courts are required to take bonds, with fecurity,
from the fheriffs of their refpective counties annually, which, in cafes where the
fame has been neglected, cannot now be done without the interpofition of the le-
giflature, and it is right and proper that bonds fhould be given by the faid fheriffs ;

II. Be it enacted, by the General Affembly of Maryland, That the chief juftice
of any county court, or the affociate juftices, be and they are hereby authorifed
and empowered, on or before the fourth Monday in December next, to call a
court before the time to which the county court ftands adjourned, and that he or
they, as the cafe may be, fhall and may take bond, with fuch fecurity as he or
they may approve, of the fheriff, in the manner required by law; and the pro-
ceedings of the faid chief juftice, or aflbeiate juftiees, fhall be good and valid in
law, to all intents and purpofes, any law to the contrary notwithftanding.

C H A. P. LXIII.

cember 23.

A Supplement to the act, entitled, An act refpecting the equity

jurifdiction of the county courts.

Preamble.

WHEREAS by the act, entitled, An act receding the equity jurif-
diction of the county courts, paffed at November feffion, feventeen
hundred and ninety-one, it is provided, that the faid act fhall not be
conftrued fo as to give any county court an original equity jurifdidion for the
purpofe of compelling a fpecific performance of any agreement ;

Provifion re-
pealed.

II. Be it enacted, by the General Affembly of Maryland, That the faid provi-
fion be and the fame is hereby repealed.

In certain

to have a ju-
rifdiction, &c.

III. And be it enacted, That in all cafes of bond, or other agreement, for the
conveyance of land, or of any other contract or agreement whatfoever, where

the land, or other matter or thing, in difpute, fhall not exceed the value of one
hundred pounds current money, or ten thoufand pounds of tobacco, the juftiees
of the feveral county courts of this ftate refpectively may and fhall have and
exercife, and they are hereby inverted with, an original equity jurifdiction for the
purpofe of compelling a fpecific performance of fuch contract or agreement, as
full and ample, in all refpects, as the court of chancery of this ftate doth or may
poffefs or exercife in fuch cafes, any law to the contrary notwithftanding.

Provifo.

IV. Provided, That nothing in this act contained fhall extend, or be con-
ftrued to extend, fo as to limit, abridge or reftrain, the jurifdiction of the chan-
cery court of this ftate in any manner or refpect whatever.

Proviso.

V. And provided also, and be it enacted, That all and every perfon or per-
fons who fhall or may think themfelves aggrieved by the decree of any county
court in any cafe of which fuch county court may have an equity jurifdiction by
virtue of this act, fhall be at liberty, in all cafes where the land, or other matter
