1792.

out feveral roads, in virtue of which the road formerly leading by the faid mill
has been removed, and another road laid out, by which they are deprived of the
advantage they would have had in the purchafe of wheat and other produce; and
have prayed that a road may be laid out and opened, not exceeding thirty-three
feet wide, beginning near the plantation of William Fifher, and running to their
mill, and from the faid mill to the public road at or near Carroll's manor, and
a number of the inhabitants of Anne-Arundel county having alfo prayed that
the prayer of the faid petition may be granted, and the major part of the owners
of land, where the faid road will pafs, having confented to the fame; and this
general affembly thinking the prayer of the faid petition reafonable,

XVIII.

II. Be it enacted, by the General Affembly of Maryland, That Charles Alexan-
der Warfield, Reuben Merriweather and Richard Dorley, fon of John, or any
two of them, be and are hereby appointed commiffioners to furvey, lay out and
open, at the expence of tbe faid Benjamin Lawrence and Elias Dorley, a road,
not exceeding thirty-three feet wide, in fuch direction as the fituation of the
country will admit, and beft anfwer the purpofes of this act, from the public
road leading from the Baltimore county turnpike road through Anne-Arundel
county to Frederick-town, beginning for the fame on the faid public road at or
near the plantation of William Fifher, and running to the mill of the faid Ben-
jamin Lawrence and Elias Dorfey, and from thence to interfect the faid public
road at or near Carroll's manor; and the faid road, when fo furveyed, laid out
and opened, and the valuation herein after directed to be made fhall have taken
place, fhall be recorded in Anne-Arundel county court, and fhall be deemed and
taken to be a public road for ever thereafter, and kept up, amended and repaired,
as all other public roads in the faid county.

III. And be it enacted, That the faid commiffioners fhall afcertain and value
what damages may be fuftained by any perfon or perfons through whofe land the
faid road fhall pafs, and the fame, when fo affeffed, fhall be paid, or fecured to
be paid, by the faid Benjamin Lawrence and Elias Dorfey, before the faid com-
miffioners ihall proceed to open the faid road: Provided always, that if any per-
fon or perfons, through whofe land the faid road fhall pafs, or his, her or their
guardian or truftee, fhall conceive themfelves aggrieved by fuch valuation and
affeffment of damages by the faid commiffioners, it fhall and may be lawful for
the faid commiffioners, or any two of them, to iffue their warrant to any confta-
ble of the county, to fummon five freeholders of the county, not interefted in
the premifes, and qualified to ferve as jurors in the county court, to appear, on a
day by them to be appointed, on the premifes, and the faid commiffioners are
hereby authorifed to adminifter an oath to every perfon fo fummoned, that he
will, without favour, affection, prejudice or partiality, affefs the damages fuf-
tained by the perfons at whofe requeft fuch inquifition fhall be taken, by reafon
of opening the aforefaid road through his, her, or their land; and the perfons fo
fummoned and fworn, fhall thereupon proceed to affefs and value the damages
accordingly, of which the faid Benjamin Lawrence and Elias Dorfey, or one of
them, fhall have had at leaft five days previous notice; and fuch inquifition fhall
be final and conclufive between the parties.

IV. And be it enacted, That the faid commiffioners Ihall not lay out or open
the faid road through the buildings, gardens or orchards, of any perfon, without
his or her confent.

CHAP. XIX.

Road not to
go through
buildings, &c.

An ACT to empower and authorise certain commiffioners of
Dorchefter and Caroline counties to open a main road, and
change the old road, which was formerly the divifion of the iaid
counties, at the North-Weft Fork bridge, and the fame, when
fo changed, to be the divifion of the faid counties.

WHEREAS it is reprefented to this general aflembly, by the petition of
fundry inhabitants of Dorchefter and Caroline counties, that the
main road which has heretofore been eflablifhed and confidered as the
