AN ACT to repeal and re-enact, with amendments, Sections 2(b),
32(a), 69 and 72 of Article 78 of the Annotated Code of Maryland
(1957 Edition), title "Public Service Commission Law", sub-
titles "General Provisions", "Functions, Duties and Powers of
the Commission", subheading "Rates"; to add new Sections 2(gg),
2(hh), 27(d), 32(d), and 33(c) to said article TO FOLLOW IM-
MEDIATELY AFTER SECTIONS 2(G), 2(H), 27(C), 32(C),
AND 33(B) RESPECTIVELY THEREOF, sub-titles "General
Provisions", "Public Service Companies", subheadings "Carrier
Companies", "Functions, Duties and Powers of the Commission";
to repeal Section 31(d) of said Article 78, subtitle "Public Serv-
ice Companies", subheading "Carrier Companies" and to enact
new Section 31(d) in lieu thereof, to stand in the place and stead
of the section so repealed, to include in the Public Service Laws
of Maryland provisions concerning common and contract carriers
of flammables by motor vehicle relating to definition, rates,
charges, discrimination, schedules, permits and matters generally
relating to the carrying of flammables by common and contract
carriers in Maryland.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 2 (b), 32 (a), 69 and 72 of Article 78 of the Annotated
Code of Maryland (1957 Edition), title "Public Service Commission
Law", subtitles "General Provisions", "Functions, Duties and Pow-
ers of the Commission", subheading "Rates", be and they are hereby
repealed and re-enacted, with amendments; that new Sections 2(gg),
2(hh), 27(d), 32(d), and 33(c) be and they are hereby added to
said Article, TO FOLLOW IMMEDIATELY AFTER SECTIONS
2(G), 2(H), 27(C), 32(C), AND 33(B) RESPECTIVELY THERE-
OF, sub-titles "General Provisions", "Public Service Companies",
sub-headings "Carrier Companies", "Functions, Duties and Powers
of the Commission"; that Section 31(d) of said Article 78, sub-title
"Public Service Companies", sub-heading "Carrier Companies", be
and it is hereby repealed, and that new Section 31(d) be and it is
hereby added to said Article, to stand in the place and stead of the
section so repealed, all to read as follows:

(b) "Carriers of flammables" means (1) any motor vehicle com-
mon carrier which transports in bulk in tank vehicles, any liquid
which will give off flammable vapors at or below [250] 300 degrees
Fahrenheit, or any liquid which, when mixed with wood, sawdust,
rags or similar organic substances, will cause spontaneous heating
and ignition; and (2) [any private motor vehicle carrier whose
principal business consists of such transportation of such liquids
(except where the carrier is the owner of the cargo and the carriage
is for the purpose of sale or in furtherance of a commercial enter-
prise to which such carriage is incidental). ] any motor vehicle con-
tract carrier as defined in subsection (gg) of this Section, in bulk,
engaged in the transportation of such liquids, IN BULK, serving a
