specified list of shippers filed by such carrier under the provisions of
Section 31(d)
(1).

(gg) "Contract carriers of flammables" shall mean and include
any person which, under individual written contracts or agreements
of a term or duration of not less than 90 days, with a limited number
of persons, engages in the transportation, as a carrier of flammables,
in bulk, for compensation within the State of Maryland.

(hh) Private carriers of flammables" shall mean and include
those carriers of flammable liquids in bulk, where the carrier is the
owner of the cargo and
OR carriage is for the purpose of sale or in
the furtherance of a commercial enterprise to which carriage is
incidental
ALL CARRIERS IN THIS CLASS SHALL BE SPE-
CIFICALLY EXEMPTED FROM THE PROVISIONS OF THIS
ARTICLE.

27.
(d)

(1)    It shall be the duty of every common and contract carrier of
flammables by motor vehicle to provide safe and adequate service,
equipment, and facilities for the transportation of flammables within
the State of Maryland; to establish, observe, and enforce just and
reasonable rates, charges, and classification, and just and reason-
able regulations and practices relating thereto and to the manner
and method of presenting, and delivering flammables for transpor-
tation, the facilities for transportation, and all other matters relat-
ing to or connected with the transportation of flammables within
the State of Maryland.

(2)    All charges made for any services rendered or to be rendered
by any carrier of flammables by motor vehicle, within the State of
Maryland or in connection therewith shall be just and reasonable,
and every unjust and unreasonable charge for such service or any
part thereof is prohibited and declared to be unlawful. It shall be
unlawful for any common carrier to make, give, or came any undue
or unreasonable preference or advantage to any particular person,
locality, region, or district, in any respect whatsoever; or to subject
any particular person, locality, region, or district, to any unjust dis-
crimination or any undue or unreasonable prejudice or disadvantage
in any respect whatsoever. It shall be unlawful for any contract
carrier by motor vehicle of flammables within the State of Mary-
land to demand, charge or collect greater or less compensation for
such transportation than the charges filed in accordance with Sec-
tion 81 (d) or 27(a). Provided, however, that this subsection shall
not be construed to apply to discriminations, prejudice, or disadvan-
tage to the traffic of any other carrier of whatever description.

(3)    Nothing in this section shall be held to extinguish any rem-
edy or right of action not inconsistent herewith.

(d) Contract carriers of flammables, as well as common carriers
shall file schedules in accordance with this section, and control
