436B. The widow of every elected Judge who dies in active serv-
ice shall be paid one-half of the pension or salary the Judge would
have received if his service had been terminated by retirement and
for this purpose only, the age of the Judge is not to be considered;
the widow of any Judge eligible for retirement pension who dies after
retiring [at the age of seventy years] shall be paid one-half of the
pension or salary to which her husband was entitled at the time of
his death or to which he would have then been entitled except for the

restrictions in the provisions of Section 436A of this Act. In each

instance the pension is to be paid to the widow until her remarriage
or death. The provisions of this Section shall not apply in the case
of a widow who was married to the Judge for a period less than
three years and to a retired Judge for a period less than three years
before his retirement; [nor shall it apply in the case of a widow,
otherwise qualified, of a Judge who retired before reaching the age
of seventy years] but it shall apply to the unmarried widows, other-
wise qualified, of Judges and retired Judges who died before the
passage of this Act. The Mayor and City Council of Baltimore are
hereby expressly authorized to levy for and pay such pensions to
widows of former Judges of said People's Court of Baltimore City.

SEC. 2. And be it further enacted, That this Act shall take effect
June 1, 1959.

is then at least sixty years of age or when he becomes sixty years of
age, or when he shall have actively served at least twenty years as a
Judge of said Court, even though he has not reached the age of
sixty years,
a pension or salary calculated at the rate of Three

Hundred Fifty Dollars— ($350.00) per annum for each year or any
part thereof of active service by appointment and election as a Judge
of said People's Court, up to and including twenty years of such
active service, so that the maximum pension or salary for such
service payable hereunder to any one person shall not exceed the sum
of Seven Thousand Dollars ($7,000.00) per annum. Any former
Judge who accepts any salaried public office or position, municipal,
county, state or federal, shall not be paid any such pension or salary
so long as he remains in any such office or position. No pension shall
be payable hereunder to any retired Judge of the People's Court of
Baltimore City who is receiving another pension under the Em-
ployees' Retirement System of the City of Baltimore. Until he reaches

the age of sixty years no [No] pension shall be payable hereunder

to any former Judge who has [not] actively served as a Judge for

at least twenty (20) years [or] and who retires before he has be-

come sixty years of age [if such] so long as such former Judge

engages in the active practice of law after his retirement from the

judgeship. In the event that such a Judge retired before reaching

the age of sixty years engages in the practice of law and should.

thereafter relinquish such practice and notify the Governor and the

Comptroller of Baltimore City of such fact, then, from and after

the date of such notification such Judge shall be entitled to all the

provisions of this Section. The Mayor and City Council of Baltimore
are hereby expressly authorized to levy for and pay such pensions
or salaries to former Judges of said People's Court of Baltimore City.
