County. This facility shall be manned and operated by competent
personnel twenty-four hours a day on each and every day of the year.
(b) The Commissioners are authorized and directed to employ
such personnel for the facility and to pay such salaries as they deem
necessary.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1959.

AN ACT to add new Section 31 to Article 33A of the Annotated
Code of Maryland (1957 Edition), title "Eminent Domain", sub-
title "Surveys for Public Works", to follow immediately after
Section 30 of said Article, providing for the payment of certain
costs under certain conditions by the condemnor in the event a
property owner receives official notice of condemnation or con-
demnation proceedings ARE filed and thereafter the condemning
authority abandons the acquisition.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 31 be and it is hereby added to Article 33A of the
Annotated Code of Maryland (1957 Edition), title "Eminent Domain",
sub-title "Surveys for Public Works", to follow immediately after
Section 30 thereof, and to read as follows:
31.
(a) In cases where condemnation proceedings have been filed or
actual official notice has been given of the intent to file condemnation
proceedings and such proceedings or intent to condemn are aban-
doned, and in any case where an Inquisition has been returned by a
Jury in a condemnation case and the condemning party abandons
the acquisition, the defendant or defendants in the condemnation pro-
ceedings, or the owner or owners in cases where suit has not actually
been filed but where such official notice has been given of the intent
to file condemnation proceedings to acquire property, shall be en-
titled to recover from the condemning authority reasonable expenses
actually incurred as a result of the condemnation proceedings, or
such official notice. Such expenses shall be limited to reasonable
legal, appraisal and engineering fees actually incurred by the owner
of the property because of the condemnation suit, or such official
notice. If the condemnor and the condemnee are unable to agree as
to the amount of said fees, the matter shall be determined by a
Judge of the Circuit Court of the County (or the Superior Court of
