other purpose, and no trees shall be planted or removed or obstruc-
tions placed thereon without the written permit of the County
Roads Board or its duly authorized agent, and then only in accord-
ance with the regulations of the Board and the work shall be done
under the supervision of the Board, and the entire expense of re-
placing the county road in us good condition as before shall be paid
by the person to whom the permit was given or by whom the work
was done, and the County Roads Board may in its discretion, prior
to the issuance of the required permit, require the filing of a bond
in such sum as they, in their discretion, may deem sufficient to in-
sure the satisfactory completion of the work. Any violation of this
section shall be a misdemeanor, and the person or corporation so
violating shall be liable to prosecution at the instance of the Board
or at the instance of any taxpayer, and upon conviction before any
trial magistrate shall be fined an amount of not more than $100.00
for such offense.

380. Any person moving a motor vehicle over a county road,
which is either oversize or overweight as defined by Article 66½,
Section 81, of the Annotated Code of Maryland (1957 Edition)
shall first obtain a permit to be issued by the County Roads Board.
The permit shall specify the route to be followed, the hour and date
on which the passage is to be effected, and the maximum size and
weight. Any person moving a motor vehicle over a county road which
is either oversize or overweight as hereinabove set forth, without
first obtaining a permit from the County Roads Board, shall be
guilty of a misdemeanor, and upon conviction, shall be fined not
more than $100.00.

Sec. 2. And be it further enacted, That if any clause, sentence,
part or parts of this Act, or of any section thereof shall be held un-
constitutional, such unconstitutionality shall not affect the validity
of the remaining parts of this Act or of any section thereof. The
Legislature hereby declares that it would have passed the remain-
ing parts of this Act or any section thereof, if it had known such
clause, sentence, part or parts or any section thereof should be de-
clared unconstitutional.

Sec 3. And be it further enacted, That this Act shall take effect
June 1, 1959.
