CHAPTER 300
(Senate Bill 429)

AN ACT to repeal and re-enact, with amendments, Section 337D (c)
of the Code of Public Local Laws of Allegany County (1955 Edi-
tion, being Article 1 of the Code of Public Local Laws of Mary-
land), as enacted by Chapter 228 of the Acts of 1957, title "Alle-
gany County", sub-title "LaVale Zoning Board", changing the time
required for candidates for the LaVale Zoning Board to have
petition filed with Chairman of the Board of Election Supervisors.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 337D (c) of the Code of Public Local Laws of Allegany
County (1955 Edition, being Article 1 of the Code of Public Local
Laws of Maryland), as enacted by Chapter 228 of the Acts of 1957,
title "Allegany County", sub-title "LaVale Zoning Board", be and it
is hereby repealed and re-enacted, with amendments, to read as
follows:

337D.

(c) The election of a member to said Board in the 1958 general
election, and all subsequent elections, shall be upon the same terms
and conditions as set forth above, and also shall be conducted by the
Board of Election Supervisors of Allegany County simultaneously
with the balloting for all other elective offices. At all these subsequent
elections, beginning with the election of 1958, all candidates for
office must have their petitions fully certified and presented to the
Chairman of the Board of Election Supervisors at least [twenty (20)
days] sixty (60) days prior to such election. The person elected to
office at the 1958 election shall hold office for a period of six years.
In a similar manner, the member elected to serve until 1960 shall be
replaced or re-elected at the 1960 election, and the candidate elected
to serve until 1962 shall be replaced or re-elected at the 1962 elec-
tion. Thereafter members of the Board whose terms expire shall be
replaced or re-elected every two years for a term of six years. The
Chairman of the Board shall be chosen by its members after each
general election. Members of the Board shall serve without compen-
sation. In the event of the removal from office of any member, or
his failure to qualify, or his death in office, or for his inability to
serve for any reason whatsoever, this sub-title shall not fail for want
of a member of the Board, but in all such cases the Board of County
Commissioners for Allegany County shall appoint a person to serve
as a member of the Board to fill the unexpired term of the member
of the Board. In the event that the original Board cannot or is not
for any reason whatsoever elected at the June 18, 1957, referendum
and election, the Board of County Commissioners of Allegany County
shall appoint the entire Board as aforesaid. The LaVale Zoning
Board shall exercise such duties, powers and authority as may be
necessary and advisable for the proper administration and enforce-
ment of this sub-title.
