istrates System", relating to an associate trial magistrate for Kent
County, to his powers and salary, and relating generally to trial
magistrates in Kent County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 108 (14) and 119 (a) of Article 52 of the Annotated
Code of Maryland (1957 Edition), title "Justices of the Peace", sub-
title "Trial Magistrates System", be and they are hereby repealed
and re-enacted, with amendments, to read as follows:

108.

(14) Kent County.—There shall be one trial magistrate who shall
sit at Chestertown and who shall receive an annual salary of
$1,800.00. There shall also be one associate trial magistrate who shall
receive an annual salary of $1,000.00. During the temporary absence
or inability of the trial magistrate, the associate shall serve in his
place with the same authority and power as the trial magistrate. In
such case he shall receive from the County Commissioners the same
pro rata amount as compensation that the magistrate would have
received, and the same expenses the magistrate would have received.
The salary of the magistrate shall in such cases be diminished by a
sum necessary to compensate the associate magistrate for any period
of absence or inability in excess of thirty days in any one year.
The
Sheriff of Kent County and his deputies are hereby authorized,
directed and required to serve all civil and criminal process issued
by said magistrate.

119.

(a) Appointment; bonds; compensation.—In addition to the jus-
tices of the peace and justices of the peace at large hereinbefore
specified, the Governor, by and with the advice and consent of the
Senate, shall appoint one justice of the peace at large for each county
of the State, except Montgomery [County] and Kent Counties, who
shall be designated "substitute trial magistrate." Such magistrate
shall post the bond required of trial magistrates and shall receive a
salary of $100.00 per year, except there shall be three substitute
magistrates appointed for Baltimore County, each of whom shall re-
ceive $1,800.00 per year in addition to the compensation received
when actually sitting as a substitute as hereinafter provided and ex-
cept the substitute magistrate appointed for [Kent and Somerset
Counties] Somerset County, who shall receive five hundred dollars
($500.00) per year in addition to the compensation received when
actually sitting as a substitute, as hereinafter provided, and except
the substitute magistrate appointed for Prince George's County, who
shall receive $1,300.00 per year, in addition to the compensation re-
ceived when actually sitting as a substitute, as hereinafter provided,
and except the substitute magistrate appointed for Cecil County, who
shall receive $300.00 per year in addition to the compensation received
when actually sitting as a substitute, as hereinafter provided. And in
Wicomico County said substitute trial magistrate shall receive a
salary of $800.00 per year.

SEC. 2. And be it further enacted, That this Act shall take effect
June 1, 1959.
