CHAPTER 238
(House Bill 272)

AN ACT to repeal and re-enact, with amendments, Section 12 of
Article 63 of the Annotated Code of Maryland (1957 Edition),
title "Mechanics' Lien", sub-title "In General", increasing the
amount of time allowed to give notice of the intent to file a
mechanics' lien when the owner of the building is absent or can-
not be located.

Whereas, By Chapter 629 of the Acts of 1957 the Maryland Legis-
lature increased the time allowed for giving notice of the intention
to file a mechanics' lien when the owner of the building is a resident ;
which act is codified in Section 11 of the Annotated Code of Mary-
land (1957 Edition); and

Whereas, Section 12 is basically the same section except that it
pertains to giving notice to owners who cannot be located; and

Whereas, In order to make the two sections consistent; now,
therefore,

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 12 of Article 63 of the Annotated Code of Maryland
(1957 Edition), title "Mechanics' Lien", sub-title "In General", be
and it is hereby repealed and re-enacted, with amendments, and to
read as follows:

12. If such notice cannot be given on account of absence or other
causes, the claimant or his agent may, in the presence of a competent
witness and within [sixty] ninety days, place said notice upon the
door or other front part of said building and shall file a claim with
the clerk of the circuit court for the county or the Circuit Court of
Baltimore City, as the case may be, as hereinafter mentioned.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1959.
