SEC. 5. And be it further enacted, That Section 178 of Article 56
of the Annotated Code of Maryland (1957 Edition), title "Licenses",
sub-title "Miscellaneous Licenses", be and it hereby is repealed and
re-enacted, with amendments, to read as follows:
178.
Each person, firm or corporation, resident or non-resident, oper-
ating or conducting a restaurant or eating place, shall, before doing
so, take out a license therefor, and shall pay an annual license fee
of ten dollars ($10.00) for each place of business so operated ex-
cept that in incorporated towns and cities of 8,000 inhabitants or
over, the fee for each place of business so operated shall be twenty-
five dollars ($25.00). Provided, however, that this Section shall not
apply in Montgomery County.
Sec. 6. And be it further enacted, That this Act shall take effect
July 1, 1959.

AN ACT to repeal and re-enact, with amendments, Section 60 of
Article 25 of the Annotated Code of Maryland (1957 Edition),
title "County Commissioners", sub-title "Draining Lands", relat-
ing to the report of the Board of Viewers to the County Com-
missioners in the procedure for locating and establishing drain-
age ditches.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 60 of Article 25 of the Annotated Code of Maryland
(1957 Edition), title "County Commissioners", sub-title "Draining
Lands", be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:
60.
The Board of Drainage Viewers shall make out and return to the
Board of County Commissioners, at the earliest practical date, a
written report, in triplicate, which shall set forth:
(1) Whether the proposed drainage is practical.
(2) Whether it will promote the public benefit or utility, or the
public health, convenience or welfare.
(3) Whether the improvements proposed will benefit the lands
in question sufficiently to warrant the probable expenditure.
