hereby is repealed and re-enacted, with amendments, to read as
follows:

9. It shall be the duty of the sheriffs and constables of the sev-
eral counties and Baltimore City and the agents and inspectors of
the Comptroller to make diligent inquiry of all persons, firms and
corporations doing business in this State, and apprehend and cause
the arrest of all persons, firms and corporations found doing busi-
ness without a license, as may be required by law, to answer the
charge of selling goods without a license. Any person, firm or cor-
poration selling goods without a license as required by law, shall
be guilty of a misdemeanor, and, upon conviction thereof, shall be
fined not exceeding $100 or imprisoned for not more than thirty
days; the penalty herein prescribed not to affect the penalty which
may be prescribed by existing law for the violation of special pro-
visions of the license laws. Provided, however, that this Section, in-
sofar as it relates to restaurant or eating places, shall not apply in
Montgomery County.

Sec. 4. And be it further enacted, That Section 11 of Article 56
of the Annotated Code of Maryland (1957 Edition), title "Licenses",
sub-title "Mode of Issuing—General Provisions", be and it is hereby
repealed and re-enacted, with amendments, to read as follows:

11. The Comptroller of the Treasury be and he is hereby au-
thorized and directed to appoint some suitable person who shall be
attached to his office and who shall be designated as chief inspector
of State licenses; and the Comptroller of the treasury be and he is
hereby further authorized to appoint three assistant inspectors of
State licenses; the compensation of said chief inspector and said
assistant inspectors to be fixed in the budget to be submitted by the
Governor of Maryland and enacted by the General Assembly of
Maryland and the Comptroller of the treasury is hereby authorized
and empowered to superintend the issuance of all licenses by the
clerks of the several courts of this State, and he is further empow-
ered to investigate, through the said inspectors to be appointed
under this section, the adequacy of all licenses applied for and issued
by the clerks of the several courts of this State to the end that all
persons, firms and corporations required to procure licenses under
the laws of this State shall procure the same according to the laws
thereof, and the said inspectors, with the approval of the Comp-
troller of the treasury, shall institute proceedings for the prosecution
of all persons, firms or corporations failing to procure a license or
a license for an adequate amount, said prosecution to be in accord-
ance with Section 9 of this article, and the Comptroller of the
treasury is hereby empowered to have general supervision over the
license laws of this State.

Provided, however, that any law or part of a law under which
the State Tax Commission has exercised or may exercise any au-
thority similar to that conferred upon the State Comptroller by
this Section be and it is hereby repealed to that extent, it being
the purpose of this Section to concentrate in the office of the State
Comptroller the power to supervise the issuance of all licenses
issued by the clerks of the several courts of this State, and that this
power shall be exercised by no other official [.] , and provided fur-
ther, that this Section, insofar as it relates to restaurant or eating
places, shall not apply in Montgomery County.
