(House Joint Resolution 31)
House Joint Resolution requesting the Governor, the President of
the Senate and the Speaker of the House of Delegates to appoint
a Commission to study the economic development problems related
to water uses and to give consideration to any legislation needed
to clarify water rights as they may be related to such develop-
ment in the State for adequate future supply where needed.
Whereas, The water resources of Maryland are important and
will be of greater importance as the population and economy of the
State grow and expand; and
Whereas, The rights of landowners and others to use water are
not clearly spelled out in the statutes and court decisions have not
fully developed these rights as of this time; and
Whereas, The people of Maryland are interested in a clarification
of their rights to use water and this clarification of rights is essen-
tial in order to obtain the most beneficial use of water by the differ-
ent users in the State; and
Whereas, The problem requires study; now, therefore be it
Resolved by the General Assembly of Maryland, That the Gover-
nor, the President of the Senate and the Speaker of the House of
Delegates be requested to appoint a Commission to study the factors
related to the right to use water in Maryland and to give careful
consideration to legislation which may be required to clarify these
rights; and be it further
Resolved, That this Commission shall consist of eleven members,
including a Chairman and, on this Commission there shall be, in
addition to the Chairman, equal representation of agricultural and
urban users of water, and that the Commission be authorized to call
upon the services of technical personnel from other State agencies,
this personnel to assist the Commission in an advisory capacity; and
be it further
Resolved, That the Governor be requested to allot to this Com-
mission from contingent monies at his disposal, in order that the
Commission may conduct its study and publish its findings and re-
port; and be it further
