(r) (1) It shall be unlawful to take or catch soft shell clams, in any
manner whatsoever in, on or upon any area which has been closed
by any rule or regulation of the Commission of Tidewater Fisheries.
(2) The said Commission of Tidewater Fisheries is to publish and
make available to licensed clam dredgers, and all other interested
persons, the regulations and rules from time to time promulgated by
the Commission pertaining to the taking, catching, marketing and
disposition of soft shell clams.
(3) The Department of Research and Education and the Com-
mission of Tidewater Fisheries shall, as said agencies or either of
them shall deem necessary or proper, from time to time determine,
the actual condition of shellfish populations existing in the waters or
submerged bottoms of those counties, or in the waters of the Chesa-
peake Bay adjacent to said counties, where dredging for soft shell
clams, is permitted and authorized; and to correct and amend charts,
or prepare new charts in accordance with the findings and determina-
tions thereof.; BUT UNDER NO CONDITIONS SHALL ANY
SURVEY OR RESURVEY BE MADE IN ANY AREA OR BOT-
TOM HEREIN SPECIFICALLY PROHIBITED, NOR SHALL THE
DEPARTMENT OF TIDEWATER FISHERIES UNDER ANY
CONDITIONS BE AUTHORIZED TO OPEN ANY AREA OR
BOTTOM OTHERWISE SPECIFICALLY PROHIBITED BY THIS
ARTICLE.
