be approved by him as to their sufficiency and compliance with the
laws and conditions under which executed.
382D. (a) Whenever any Officer, Department, Board, Commission
or agency shall require legal advice concerning his or its official busi-
ness or whenever any legal question or dispute arises or litigation
has been or is to be commenced in which any Officer, Department,
Board, Commission or Agency is officially concerned, it shall be the
duty of such Officer, Department, Board, Commission or Agency to
refer the same to the County Solicitor. It shall be unlawful for any
Officer, Department, Board, Commission or Agency to engage any
attorney other than the County Solicitor to represent him or it in
any matter or thing relating to his or its public business without the
approval in writing of the Commissioners of Anne Arundel County.
(b) It shall be the duty of any Officer, Department, Board, Com-
mission or Agency, having requested and received legal advice from
the County Solicitor regarding his or its official duty, to follow the
same; and when any officer shall follow the advice given him in
writing by the County Solicitor he shall not be liable in any way for
so doing upon his official bond or otherwise.
382E. The County Solicitor shall have sole charge and direction of
the preparation and trial of all suits, actions and legal proceedings
of every kind to which the County, its Commissioners or any Depart-
ment, Commission, Board, Agency or Officer thereof as such shall
be a party. He shall have authority to institute, defend or discontinue
on behalf of the County, any suit, action or legal proceedings in any
local, State or Federal Court or before any administrative agency
thereof. Provided, however, that no appeals on behalf of the County
shall be taken to the Court of Appeals of Maryland, to the United
States Circuit Court of Appeals, or to the United States Supreme
Court, except upon the written order of the County Solicitor, ap-
proved by the Commissioners of Anne Arundel County.
382F. (a) The County Solicitor shall prepare or assist in pre-
paring all ordinances and resolutions for introduction before and con-
sideration by the Commissioners of Anne Arundel County.
(b) The County Solicitor shall prepare all Bills which the Com-
missioners of Anne Arundel County shall desire to be introduced
before the General Assembly of Maryland.
382G. The County Solicitor shall have the right of access at all
times to the official records of any Officer, Department, Board, Com-
mission or Agency of the County.
382H. The County Solicitor, with the approval of the County Com-
missioners, shall, upon the establishment of the County Law Depart-
ment, appoint two assistants, both of whom must be members of the
Bars of the Court of Appeals of Maryland and of the Circuit Court
for Anne Arundel County, and both of whom must be residents of the
County. One shall be designated Deputy County Solicitor, and the
other as Assistant County Solicitor. Both shall be under the direction
and supervision of the County Solicitor in the conduct and perform-
ance of the legal business of the County. Whenever in the opinion of
the County Commissioners it should become necessary to do so, they
are hereby authorized to direct the County Solicitor to appoint assist-
ants in addition to those hereinbefore specified.
