405. (Fees; Accounting). Every applicant shall pay to the Com-
mission, at the time of making his application, a fee of [Ten
Dollars ($10.00)] Fifty Dollars ($50.00) FIFTEEN DOLLARS
($15.00); in addition, any applicant who fails to pass any
examination, shall pay a fee of Five Dollars ($5.00) for each
re-examination or subsequent examination given to him. Every
person to whom a Certified Tree Expert [certificate] license
has been issued shall pay an annual renewal fee of [Five Dollars
($5.00)] Ten Dollars ($10.00). From the fees collected under this
sub-title the Commission shall pay all expenses of issuing [certifi-
cates] licenses and traveling expenses of its members in the per-
formance of their duties under this sub-heading, and if any surplus
[remain] remains on the thirtieth day of June of each year, this shall
be paid into the Treasury of the State, for the use of the Department
of Forests and Parks, to the extent that such surplus exceeds One
Thousand Dollars ($1,000.00) which will be retained by the Com-
mission of Forests and Parks as a working fund; provided, that no
expenses incurred under this sub-title shall be charged against the
funds of the State of Maryland. The Commission shall annually re-
port to the Governor the number of [certificates] licenses issued
and the receipts and expenses under this sub-title during each fiscal
year.
406. (Revocation and Suspension of [Certificates] Licenses.) The
Commission of Forests and Parks, by majority vote thereof, may
permanently revoke or temporarily suspend any [certificate] license,
of any Licensed Certified Tree Expert who has been guilty of any
fraud or deceit in obtaining such [certificate] license, or who has
been guilty of negligence or wrongful conduct in the practice of
[professional] tree culture or care. The Commission may promul-
gate, and may amend, from time to time, rules of [professional]
ethics and may temporarily suspend for a period not to exceed two
years the [certificate] license of any Licensed Certified Tree Expert
who violates such rules of [professional] ethics, this power of
suspension being in addition to and not in limitation of the power to
revoke or suspend heretofore provided in this section. No [certifi-
cate] license issued under this sub-heading shall be revoked or the
effect thereof suspended until the holder shall have had a hearing
before the Commission. Notice of the cause for suspension or
revocation under this section and the date of hearing thereon by
the Commission shall be mailed to the holder of such certificate at
his or her last known address at least twenty days before said
hearing. The non-appearance of the holder of such [certificate]
license after notice as herein provided shall not prevent such hear-
ing. By majority vote the Commission may re-issue any certified
tree expert's [certificate] license previously revoked. Any person
not a citizen of the United States when he or she receives a [certifi-
cate] license issued under this sub-heading shall have such [certifi-
cate] license revoked unless within six years from the receipt thereof
he or she has become a citizen of the United States.
407. (False Representations; Penalties.) If any person shall
solicit, advertise, or represent himself or herself to the public as
qualified to do any type of tree culture or care and as having received
a [certificate] license as provided for in this sub-heading, or shall
assume to practice as a Licensed Certified Tree Expert without
