to examine applicants for [certification as] license as certified tree
experts and to pass upon their competency as such. The Director
as administrative head of the Department of Forests and Parks shall
be deemed to be the duly authorized agent of the Commission of
Forests and Parks.
403. (Issuance of [Certificates] Licenses; Qualifications). The
Commission of Forests and Parks shall issue and grant a "Certified
Tree Expert" [certificate] license to any applicant, who, in the opin-
ion of the Commission, has qualified by the following:
(1) who pays the fees hereinafter provided;
(2) who is a citizen of the United States or who has duly declared
his or her intention of becoming such citizen;
(3) who is over the age of twenty-one years;
(4) who is of good moral character;
(5) (a) who has had four years of approved college education,
preferably in forestry, landscaping or agriculture, or the equivalent;
or
(b) who, in the opinion of the Commission has had sufficient pro-
fessional experience in tree care to justify waiver of the require-
ment of four years of college or an equivalent education; or
(c) who shall have continuously for at least five years immediately
preceding the date of his application been engaged in practice as a
tree expert; or
(6) who shall have successfully passed such examinations, as may
be given by the Commission as hereafter provided.
(7) all licensees shall show proof of and carry liability and property
damage insurance at the time of issuing of said license and shall
maintain said insurance protection for the period the license is in
effect.
404. (Examinations). The Commission shall prepare all examina-
tions hereinabove provided for, and shall conduct the same as often
as it deems necessary, but at least once each year, if there are any
applicants. Every applicant who has never been [certified] licensed
under this sub-heading or who has not been the holder of an operative
[certificate] license for three years next preceding the date of appli-
cation, must take and pass the examinations prescribed by the Com-
mission; provided that the Commission may, in its discretion, tempo-
rarily waive for a period of not exceeding six months after June 1,
1945, the requirement for an examination of an applicant who on
June 1, 1945, is actively engaged in the practice of tree culture and
care and has been so engaged for at least five years next preceding
said date. A candidate who shall have passed a satisfactory examina-
tion in all but one of the subjects given by the Commission may be
re-examined in that subject only, at subsequent examinations held
by the Commission, and if he passes in that subject he shall be con-
sidered to have passed the examinations. Nothing in this sub-title
shall be construed as prohibiting the re-examination in all subjects
of a candidate who has failed in a prior examination.
