(House Bill 271)
AN ACT to repeal and re-enact, with amendments, Section 115 of
Article 93 of the Annotated Code of Maryland (1951 Edition),
title "Testamentary Law", sub-title "Debts", relating to the time
within which claims must be brought against an estate after refusal
to pay the claim.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 115 of Article 93 of the Annotated Code of Maryland
(1951 Edition), title "Testamentary Law", sub-title "Debts", be and
it is hereby repealed and re-enacted, with amendments, to read as
follows:
115. If a claim shall be asserted against or exhibited to an admin-
istrator or executor in any form, whether sworn to or passed by the
Orphans' Court or not, and he shall refuse payment thereof in
writing, such claim shall be forever barred unless the creditor shall
bring suit upon the same within [nine] three SIX months after such
rejection.
Sec. 2. This section shall not be construed to extend or apply to
any claims refused by the executor or administrator thereof prior to
the effective date of this Act.
Sec. 3. And be it further enacted, That this Act shall take effect
June 1, 1957.
