CHAPTER 391
(Senate Bill 267)

AN ACT to repeal and re-enact, with amendments, Section 16 (a) of
Article 95A of the Annotated Code of Maryland (1951 Edition),
title "Unemployment Insurance Law", sub-title "Penalties", and
to add Section 16 (f) to said Article and sub-title of the Code, to
follow after Section 16 (e) thereof, providing for prosecution of
fraudulent obtainment of benefits under an unemployment insur-
ance law of any foreign state or government and establishing a
two-year period for the prosecution of offenses under this section.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 16 (a) of Article 95A of the Annotated Code of Mary-
land (1951 Edition), title "Unemployment Insurance Law", sub-title
"Penalties", be and it is hereby repealed and re-enacted, with amend-
ments, and that Section 16 (f) be and it is hereby added to said
Article and sub-title of the Code, to follow immediately after Section
16 (e) thereof, and all to read as follows:

16. (a) Whoever makes a false statement or representation
knowing it to be false or knowingly fails to disclose a material fact,
to obtain or increase any benefit or other payment under this Article,
or under an unemployment insurance law of any other state, or of
the Federal Government, or of a foreign government,
either for him-
self or for any other person, shall be punished by a fine of not less
than $50.00 nor more than $500.00 or by imprisonment for not longer
than ninety days or by both such fine and imprisonment; and each
false statement or representation or failure to disclose a material
fact shall constitute a separate offense.

16. (f) Prosecution under sub-sections (a), (b) and (c) of this
section must be commenced within two years from the date of the
commission of the offenses described therein.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1957.
