CHAPTER 390
(Senate Bill 265)

AN ACT to repeal and re-enact, with amendments, Section 7(c) (7)
of Article 95A of the Annotated Code of Maryland (1951 Edition),
title "Unemployment Insurance Law", sub-title "Contributions",
relating to the experience rating of employees under unemploy-
ment insurance in certain cases of termination of employment by

employees. CERTAIN CONDITIONS UNDER WHICH BENE-
FITS WILL NOT BE CHARGED TO THE EXPERIENCE RAT-
ING ACCOUNT OF EMPLOYERS.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 7(c) (7) of Article 95A of the Annotated Code of
Maryland (1951 Edition), title "Unemployment Insurance Law",
sub-title "Contributions", be and it is hereby repealed and re-
enacted, with amendments, to read as follows:

7 (c) (7) For the purposes of the experience rating provisions of
this sub-section, in any case where a claim for benefits is filed, an
employer's account shall not be charged with benefits paid, and shall
not be credited with base period wages on which such benefits were
or would have been based, for the purposes of any computation made
for any fiscal year beginning after the date of separation from em-
ployment
[and no portion of the wages paid to any individual shall
be determined to be the employee's or employer's benefit wages for
any benefit year or base period], if such individual left the service
of the employer voluntarily without good cause attributable to his
employer; or if such individual left or was suspended from the serv-
ice of the employer by reason of any circumstances [occurrence for]
under which he was [or might have been] disqualified for benefits
under the provisions of Section 5 of this Article [.], or under which
he could have been so disqualified had he filed claim during the period
for which such disqualification would have been effective.

In the event that it is determined by the Board that an individual
has received benefits which are recoverable by the Board under the
terms of Sections 16 (d) or 16 (e) of this Article, the benefits so re-
ceived shall not, for the purposes of the experience rating provisions
of this subsection, be charged against the account of any employer
in any computation made for any fiscal year commencing after the
date of the determination by the Board, provided no benefit charges
shall be removed from the employer's account if the payment of such
benefits was made as a direct or indirect result of the employer's
failure to provide information to the Board as required by this Act
or the regulations promulgated pursuant thereto.

Sec. 2. And be it further enacted, That this Act shall take effect
on June 1, 1957.
