under six years of age. The amount shall be in his discretion, except
that it shall not be less than Two Hundred and Fifty Thousand Dollars
($250,000.) annually. The appropriation as finally determined by the
General Assembly shall be expended under the supervision and con-
trol of the State Department of Education. For the purposes of this
program, a handicapped child shall be one with a physical impairment
or mental retardation which, in the judgment of the Department,
makes a special educational and training program necessary or
desirable to help the child attain a scholastic achievement as near-
normal as feasible. The Department of Education shall adopt stand-
ards and promulgate rules and regulations based thereon, for the
non-medical examination, classification and education of such handi-
capped children, for the qualifications of teachers, for curriculum and
equipment, and generally for the supervision and operation of the
program herein provided for.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1957.

(Senate Bill 12)

AN ACT to repeal and re-enact, with amendments, Section 64 of
Article 77 of the Annotated Code of Maryland (1956 Supplement),
title "Public Education", sub-title "Chapter 4. County Board of
Education", providing for a census of handicapped children both
of school age and of pre-school age, and for the use of the data
so collected.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 64 of Article 77 of the Annotated Code of Maryland
(1956 Supplement), title "Public Education", sub-title "Chapter 4.
County Board of Education", be and it is hereby repealed and re-
enacted with amendments, to read as follows:

64. School census.

The county board of education and the board of school commission-
ers of Baltimore City may cause to be taken, under the direction of
the county superintendent of schools or the superintendent of public
instruction of Baltimore City, a school census of the children under
eighteen years of age, including a census of handicapped children
both of school age and of pre-school age.
Whosoever has under his
control a child under eighteen years of age and withholds the informa-
tion in his possession from any officer demanding it, relating to the
items aforesaid, or makes any false statement in regard to the same,
shall be deemed guilty of a misdemeanor and be fined not more than
