CHAPTER 383
(Senate Bill 170)

AN ACT to repeal and re-enact, with amendments, Section 8 of
Article 15A of the Annotated Code of Maryland (1951 Edition),
title "Budget and Procurement", sub-title "Budgetary Administra-
tion", imposing certain conditions upon the effectiveness of a
budget amendment which increases the salary or salaries of any
person or persons. OFFICE OR POSITION.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 8 of Article 15A of the Annotated Code of Maryland
(1951 Edition), title "Budget and Procurement", sub-title "Budgetary
Administration", be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

8. (a) The items and amounts making up the appropriation in
any budget bill, supplementary appropriation bill or bond issue bill
shall represent the initial plan of disbursement and apportionment
of the appropriations of which they are part. Each appropriation
shall be paid out only in accordance with the schedule therefor, unless
such schedule be amended, within the limits of such appropriation,
in the following manner:

(b)  The Senate may by resolution provide for or authorize, the
amendment of its schedule.

(c)  The House of Delegates may by resolution provide for or
authorize the amendment of its schedule.

(d)  The Governor may himself make an amendment schedule, if
the same be necessary, with respect to the appropriations for the
Executive Department, and upon its transmission to the Comptroller
the appropriation for such department shall be paid out in accord-
ance with such amended schedule, subject to the provisions of sub-
section (f).

(e)  Any department, board, commission, officer or institution
may, at any time submit in writing to the Governor an amended
schedule for the disbursement and apportionment of the appropria-
tions made to it by him. If the Governor shall approve such amended
schedule he shall transmit the same, with the certificate of approval,
to the Comptroller and thereafter, such appropriation shall be paid
out in accordance with said amended schedule, subject to the provi-
sions of sub-section (f).
Any such amended schedule so submitted to
the Governor may be withdrawn at any time before the Governor has
acted thereon. Any amended schedule approved by the Governor may
be again amended at any time in like manner and with like effect. All
amendments and schedules made or approved by the Governor shall
be reported by him to the next session of the General Assembly.

(f)  A budget amendment shall not increase the salary or salaries
of any person or persons
