AN ACT to repeal and re-enact, with amendments, Section 114 of
Article 77 of the Annotated Code of Maryland (1956 Supplement),
title "Public Education", sub-title "Teachers' Retirement System",
AND SECTION 25 OF ARTICLE 73B OF SAID CODE, TITLE
"PENSIONS", SUB-TITLE "EMPLOYEES OF MUNICIPAL
CORPORATIONS", amending the provisions applicable in Anne
Arundel County concerning additional payments to certain retired
public school teachers to supplement their retirement benefits.
RELATING TO ADDITIONAL PAYMENTS TO CERTAIN RE-
TIRED PUBLIC SCHOOL TEACHERS AND COUNTY EM-
PLOYEES IN ANNE ARUNDEL COUNTY.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 114 of Article 77 of the Annotated Code of Maryland
(1956 Supplement), title "Public Education", sub-title "Teachers'
Retirement System", be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

114. Additional payments when retirement benefits below certain
amounts.

(a)   When benefits less than $100 per month.—Any school teacher
who is retired and who is receiving any retirement benefits under
the provisions of this sub-title, where such benefits in the aggregate
are less than $100.00 per month, shall receive an additional sum not
exceeding $25.00 per month upon application to the county commis-
sioners, and said commissioners shall annually levy an amount suffi-
cient to pay such additional benefits. Provided, that this subsection
shall apply only in [Anne Arundel and] Cecil [counties] county.
Provided, also, that the sum granted to any applicant by the said
county commissioners shall be such that when added to whatever
any such person is receiving from the teachers' retirement system,
the total shall not exceed¹ one hundred dollars per month.

(b)   When benefits less than $125 per month.—Any school teacher
who is retired and who is receiving any retirement benefits under
the provisions of this sub-title, when such benefits in the aggregate
are less than $125.00 per month shall receive an additional sum not
exceeding $50.00 per month upon application to the county commis-
sioners, and said commissioners shall levy annually an amount suffi-
cient to pay such additional benefits. Provided that this section shall
apply only in Anne Arundel County, Carroll County and Wicomico
County. Provided also that the sum granted to any applicant by the
said county commissioners shall be such that when added to whatever
any such person is receiving from the teachers' retirement system
the total shall not exceed $125.00 per month. PROVIDED FUR-
THER IN ANNE ARUNDEL COUNTY THAT THE ADDITIONAL
SUMS HEREIN AUTHORIZED SHALL NOT BE PAID TO ANY
SUCH TEACHER WHO RECEIVES BOTH RETIREMENT BEN-
EFITS FROM THE TEACHERS' RETIREMENT SYSTEM AND
FEDERAL SOCIAL SECURITY BENEFITS.

SEC. 2. AND BE IT FURTHER ENACTED, THAT SECTION
25 OF ARTICLE 73B OF SAID CODE, TITLE "PENSIONS", SUB-
