ments of mortgages or releases., PROVIDED, HOWEVER, UPON
ANY REFINANCING OF PROPERTY, BY THE ORIGINAL
MORTGAGOR OR MORTGAGORS THE TAX SHALL APPLY
ONLY TO THE CONSIDERATION OVER AND ABOVE THE
AMOUNT OF THE ORIGINAL MORTGAGE OR DEED OF TRUST.

(b)  The tax herein above imposed shall be paid to and collected
by the Treasurer of Prince George's County
, and paid over by said
Treasurer to the County Commissioners. The party offering for
record an instrument in writing transferring title to real property,

or in AN interest thereon THEREIN, in Prince George's County shall
pay the tax imposed above to the Treasurer and, upon such payment,
said Treasurer shall enter notation of such payment to the Treasurer
upon such Instrument of Writing conveying title.

(c)  In the case of deeds conveying property lying partly within
and partly without Prince George's County, the tax shall apply
only to such proportion of the consideration paid or to be paid as the
value of the property within this County bears to the value of the
whole property conveyed.

(d)  Upon deeds of trust or mortgages conveying property lying
partly within and partly without Prince George's County, the tax
shall apply only to such proportion of the debt secured as the value
of the property within this
PRINCE GEORGE'S County bears to
the value of the whole property conveyed.

(e)  It shall be unlawful for any person to offer for record and
record an instrument of writing conveying title to any property, or
any interest thereon, subject to the tax imposed by this section
without having paid the tax hereby imposed, and it shall be unlawful
for any person to misrepresent the amount of the actual consideration
in such transaction.

(f) Any person offering for record any such instrument of writing,
and the parties to such instrument of writing, who shall fail to pay
the tax imposed hereby before offering such instrument of writing
for record, or fail to provide for the payment of such tax before the
recording thereof, shall be subject to a sentence to pay a fine of not
more than five hundred dollars or to confinement in jail for not more
than six months.,
OR BOTH IN THE DISCRETION OF THE
COURT.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1957.
