Secretary of State the sum of One Hundred Dollars ($100) upon
filing such certificates.
(d) Fee. Candidates nominated by primary convention, meeting
and petition must pay the fee in accordance with the foregoing con-
ditions.
58. Return of Filing Fees. (a) General Provisions. In the event
that the name of any candidate who shall have paid a filing fee to
the Supervisors of Elections or to the Secretary of State as herein-
above provided, shall not appear on the official ballot at said primary
election by reason of there being no opposing candidates, such candi-
date shall not be entitled to a return of his deposit. The same shall
be retained by the Secretary of State, the Mayor and City Council
of Baltimore, the County Commissioners or County Council of the
county to which the same shall have been paid by the Supervisors of
Elections, and used in defraying the expenses of such primary
election.
(b) Members of Armed Services. In the event that any candidate
who shall have paid a filing fee to the Supervisors of Elections or
the Secretary of State, as hereinabove provided, enters into active
duty with the armed services of the United States in the period be-
tween the last date allowed for withdrawal of his name as a candidate
and the printing of the ballots or the voting machine ballot-labels,
he shall be entitled, upon request, to a return of said deposit.
59. Disposition of Filing Fees. (a) Supervisors of Elections. The
Board of Supervisors of Elections of Baltimore City shall pay over
all amounts received from filing fees to the Mayor and City Council
of Baltimore; and the Board of Supervisors of Elections for each
county shall pay over the amount so received to the County Commis-
sioners or County Council of each county, respectively.
(b) State-wide Offices. The Secretary of State shall divide and
transmit the fees received by him from candidates for State-wide
offices, in the sums of Ten Dollars ($10) each to the Supervisors of
Elections of each county of the State, and the sum of Sixty Dollars
($60) thereof to the Supervisors of Elections of Baltimore City.
(c) House of Representatives. The Secretary of State shall divide
and transmit the fees received by him from candidates for the House
of Representatives of the United States Congress, in equal amounts
to the Supervisors of Elections of each county within the respective
Congressional Districts and to the Supervisors of Elections of Balti-
more City for any LEGISLATIVE district wholly or partly therein.
60. Certificate of Candidacy in One Party Only. No certificate of
candidacy for nomination filed or offered for filing by any person
seeking a nomination for office to be a delegate to a convention, or
any executive or member of an executive committee or managing
body of a political party shall be accepted or acted upon by any
Board of Supervisors of Elections, or by the Secretary of State,
as the case may be, unless such person is affiliated on the registra-
tion records of his county or the City of Baltimore with the political
party whose nomination he seeks, at whose convention he desires to
be a delegate, or of whose committee he desires to be a member.
This provision shall apply to all nominations made at primary
