CHAP. 63.

Proviso

at the several periods therein limited, and in all respects have the
same operation as if the same had been by the said Thomas Car-
ter, deceased, executed, acknowledged and recorded, agreeably to
the acts of assembly in such case made and provided; Provided al-
ways, that nothing herein contained shall be so construed as to af-
fect the rights of any person having claims upon the estate of the
said Thomas Carter, deceased, or to prejudice the rights of any
purchaser of any of the said negroes under a bona fide sale.

CHAP. LXIV.

An Act for keeping in repair the Public Roads in Worcester County, and to re-
peal certain parts of the Acts of Assembly therein mentioned.

1. Be it enacted, by the General Assembly of Maryland, That
the fifth, tenth, eleventh, twelfth, thirteenth, sixteenth, seventeenth,
eighteenth, nineteenth, thirty-first, thirty-second, thirty-third,
thirty-fourth, thirty-fifth, thirty-sixth, thirty-seventh, thirty-eighth,
and thirty-ninth sections, of an act of assembly, passed at Decem-
ber session eighteen hundred and seventeen, entitled, An act relat-
ing to the public roads in Worcester county, be and the same are
hereby repealed.
2. And be it enacted, That it shall be the duty of each supervi-
sor to direct the hands what tools or implements they shall carry
on the road to work with, and to make such commutation of labour
for team, and carts or wagons, at the time of such notice as he may
think proper; and to appoint an early hour in each day to com-
mence working on the road, and to continue the hands, when neces-
sary, to a late hour in each day, and to see that each hand does
his duty on the road; any person neglecting to meet, or refusing to
obey the reasonable commands of the supervisor aforesaid, sued
hand, or the owner of such hand, or the person under whom such
hand may be sent, shall moreover be liable to be fined not exceed-
ing seventy-five cents, nor less than fifty cents, to be recovered and
applied as in section six of an act, passed at December session
eighteen hundred and seventeen, relating to the public roads in
Worcester county.
3. And be it enacted, That it shall be the duty of the supervisor
to direct each free male person of colour, above the ago of twenty-
one years, and under the age of fifty years, residing within his
district, to meet upon the day and at the place appointed for such
purpose by the supervisor aforesaid, and to labour in repairing the
said public roads, under the same regulations and penalties as other
persons.
4. And be it enacted, That it shall and may be lawful for the
justices of the levy court of Worcester county, on a day appointed
for that purpose, by three weeks previous notice by advertisement
set up at the court-house door, also at the most public places of the
neighbourhood the roads of which may be affected by the provisions
of this act, to proceed to offer at public sale, to the lowest bidder,
the whole, or one or more districts of the public roads in said coun-
ty, as to them in their discretion may seem expedient.
5. And be it enacted, That the levy court of Worcester county
shall, at their first levy in the year eighteen hundred and twenty-
one, and at their annual levy in every year thereafter, levy and
assess on the assessable property in said county, the sum of ten
dollars for every supervisor by them appointed, which said sum of
