ble tolls on all persons navigating or transporting any tiling along
and upon said canal, to use the water of the said canal for the
purpose, of erecting mills, manufactures, or machinery of any des-
scription, or for any purpose whatever, not prejudicial to the rights
of the present Water Company of Baltimore, first however, al-
ways obtaining the consent of all and every person interested in
the lands upon or through which any such mill, manufacture, ma-
chinery, or communication with tide water, may be or pass, and
the privileges above granted in whole or in part to sell and dis-
pose of to any person or persons, bodies politic and corporate.

CHAPTER 71.

An act to provide for the opening and extension of Pratt-
street, in the City of Baltimore.
Sec. 1. Be it enacted by the General Assembly of Maryland, That
the commissioners whose appointment is herein after provided for,
be and they are hereby authorised and empowered, to lay out and
survey Pratt-street, in the city of Baltimore, beginning for the
north side thereof, at the. south-west corner of Owings's warehouse,
situated on Light-street, and running thence easterly in a straight
line to the south-east corner of Wilson's warehouse, situated on
Franklin-lime; and for the south side thereof, beginning at a point
on Light-street wharf, not less than seventy feet south from the be-
ginning of the north side of said Pratt-street, and running thence
easterly, parallel with the north side of the said street, to Franklin-
lane; hut, the said commissioners may widen the. said street on its
south side in their discretion, provided the south side shall not be
further south than the southernmost extremity of Prestman's ware-
house on Cheapside wharf.
2. And be it enacted, That the said commissioners shall cause a
survey, and two plots, to be made, of the situation of the ground
across which the said street it; required to he laid out, and such
lots and docks as are adjacent thereto, and shall mark out and de-
signate the said street upon the said plots, and upon the ground,
and shall return, under their hands and seals, one of the plots to
be lodged in the office of the register of the city of Baltimore, there
to remain as a part of the said city, and the other plot to the of-
fice of the clerk of Baltimore county court, to be by him preserved
among the records of said court.
3. And be it enacted, That the said commissioners, after having
surveyed the grounds and designated the street as aforesaid, shall
proceed forthwith to ascertain and determine what damages will
be sustained by the owners of property lying within or adjacent to
the said street, by reason of the opening and extension thereof,
(taking into consideration all advantages and disadvantages,) pro-
vided that no claim of compensation for damage shall lie adjudged
in favour of any property which shall not be taken in whole, or in
part, for the use of the said street, or to which is not attached a
right to the use of one or more of the docks to be filled up, accord-
ing to the provisions of this act.
4. And be it enacted, That the said commissioners, after having
ascertained the damages as aforesaid, and added thereto the com-
mission allowed to the collector as herein alter provided, and an
estimate of the expense of executing their agency herein, includ-
