if the said Charles P. Graze should die, before he can, by using rea-
sonable diligence, become a citizen of the United States, nothing
contained in this proviso shall prevent him from transmitting or
transferring his said property, by descent or devise, to any person
or persons, being citizens of the United States, and residing there-
in, and capable in law to hold the same.

CHAPTER 54.

An act to vacate part of Cherry Alley, in the Town of
Cumberland, in Allegany County.

Whereas, it hath been represented to this general assembly,
that Cherry Alley, from Washington-street to Green-street, is
laid out on ground over which it is impracticable to make a passa-
ble way, and in which street is a very deep and useless well, which
is dangerous to the neighbourhood, and doubts are entertained
whether any person has a right to stop up said alley, therefore,
Sec. 1. Be it enacted by the General Assembly of Maryland, That
Cherry Alley, in the town of Cumberland, from Washington-
street to Green-street, be and the same is hereby vacated, provid-
ed the consent of the owner or owners of lots binding on said al-
ley be first obtained; and that the chief burgess, and commissioners
of the said town, be and they are hereby authorised and required
to sell the ground to the highest bidder, at public sale, for ready
cash, after having given ten days public notice of said sale, and
upon the payment of the purchase money to convey to the purcha-
ser or purchasers the said land in fee simple.
2. And be it enacted, That the money arising from said sale shall
by the chief burgess, and commissioners aforesaid, be applied to
the use of the corporation of the town of Cumberland.

CHAPTER 55.

An act authorising Turbutt R. Betton, of Queen-Anne's
County, to remove certain Negro Slaves from Fairfax
County, Virginia, into this State.

Sec. 1. Be it enacted by the General Assembly of Maryland, That
Turbutt R. Betton of Queen-Anne's county, be and he is hereby
authorised and empowered, to remove, import, and bring into this
state, at any time after the passage of this act, any negro slave or
slaves which he may be entitled to receive as his distributive share
(in right of his wife) of the estate of her father captain William
Lane, deceased, of Fairfax county, Virginia; Provided, the said
Turbutt R. Betton shall, within three months after the said slave
or slaves shall have been removed as aforesaid, make out and de-
liver to the clerk of Queen-Anne's county court, a certificate or
list of said slave or slaves, stating therein the names, ages and sex-
es, of the same, which certificate the clerk is hereby authorised
and required to record in the same manner as is directed by the
act, entitled, An act relating to negroes, and to repeal the acts of
assembly therein mentioned, passed at November session seventeen
hundred and ninety-six.
